ESPN’s Role in the Bernie Fine Investigation is Troubling
ESPN’s Outside the Lines revealed an audio tape Sunday of former Syracuse ballboy Bobby Davis talking with Laurie Fine, the wife of former Syracuse assistant coach Bernie Fine. If you haven’t heard the the troubling tape, here’s a transcript. Basically, Fine’s wife was complicit in the alleged sexual abuse of Davis by Bernie, but said nothing. The tape leaves no gray area where she stood.
It was recorded in 2002, and provided to ESPN (and the Syracuse Post-Standard) by Bobby Davis in 2003, when he first approached them about the abuse. Over eight years ago, ESPN knew about Fine’s wife basically confirming she knew her husband was a child molester.
Remember back when ESPN first broke this story on the evening of November 17th? Here’s what that first story, by Mark Schwarz and Arty Berko, said on the issue of ESPN being aware of the allegations as early as 2003:
“Outside the Lines” investigated Davis’ story in 2003, but decided not to run the story because there were no other victims who would talk, and no independent evidence to corroborate his story. In recent days, a second man, Lang, contacted “Outside the Lines” with information alleging that Fine had also molested him. Lang said he was inspired to talk after seeing news coverage of the Sandusky case.
At the time the story broke, there were questions about ESPN’s handling, but it was justifiable if they could not corroborate the story and had no independent evidence. In fact, there were some concerns about ESPN going with the story on the basis of the step-brother coming forward as the second accuser, and whether ESPN was pushing a story they could own early in the wake of the Penn State scandal.
Well, now we know that ESPN knew more than it let on. They had this tape already. The tape, along with separate news reported in the Post-Standard of a third accuser coming forward, was enough to cause Syracuse University to go ahead and fire Bernie Fine yesterday after it was released. It’s powerful, damning stuff.
And ESPN knew about it for eight years. And ESPN knew about it when they broke the story ten days ago.
It raises two separate issues. First is ESPN’s role in not addressing this eight years ago, when they did have this independent corroborating evidence from the wife’s statements. These aren’t just ambiguous statements that could be interpreted different ways. She knew. Even if she later denied it when confronted (and why wouldn’t she? She hid it for years and didn’t feel it important enough to say anything) it was pretty powerful stuff.
Second is ESPN’s handling since the story broke. They knew about this recording. They knew it on November 18th. They had to know its impact as part of the story. Did they sandbag here to create multiple news cycles? Not every part of the story emerges at once, but this is a little different than having a story develop, with nuances, after the initial news breaks. That would be what happened when the third accuser came forward, in response to the allegations.
This was information they already had. I suspect they will claim it took time to verify the voice using an expert. Why wasn’t that done before then? And why wasn’t it done at the time of initial reporting, when the evidence was already known?
This scandal involving Bernie Fine has many angles. The molester himself, of course, and the wife who enabled and looked the other way. Jim Boeheim’s vociferous defense. ESPN’s role, is troubling. This will divide up into two stories. The actual Fine investigation, and what happens at Syracuse on one hand. The media’s handling on the other – the fact that ESPN and the Post-Standard had this audio recording all along.
Something’s rotten in Bristol. ESPN is going to have to address this, and right away. Even the World Wide Leader at controlling the means and the message is going to have difficulty controlling the message on their handling of this matter.

My feelings about releasing the phone call is they released it now because they had to. The witnesses did not seem credible and they were perceived as piggy-backing on a Penn State story they were woefully unprepared for so that they could they could get cheap sweeps ratings.

Valid question. ESPN has built up it’s market share over the last decade so that you really have to work to avoid their coverage of certain events. They are so pervasive that they can survive supposed hits to their credibility. I’d like to see ESPN get humbled by people’s reaction to this, but I don’t see that happening.

That’s kind of my thinking, too. What are people going to do, not watch ESPN? Sure, a small minority may do just that, but if you want to watch live sporting events, ESPN is really the only game in town. I don’t watch them except for live sports, but that means I’m still tuned to ESPN for several hours each week. Hell, on Saturday’s in the fall I probably watch 10 hours of ESPN due to CFB. Nothing will come out of this save for some internet backlash and more jokes at ESPN’s expense. They’re too big to fail, people. Get used to it.

ESPN is really the only outlet for sporting news. I dont watch Sportscenter but I listen to a lot of ESPN radio (Carl Dukes is a clown). You can try to avoid ESPN all together but I think you would risk being uninformed regarding whats happening in sports. I guess there is always AM radio or Sirius radio..

I’ll try to find the link. I think it was in one of the many post-standard stories I looked through last night. I believe the Univ. said they did not know about the tape, but he (Davis) did say that Laurie Fine was one of the people who could corraborate. I think it said that she was interviewed by University lawyers, and denied everything and called him a liar like the morally reprehensible human that she clearly is.

I think Husker and I are both of the opinion that ESPN should face consequences for this, but it’s unlikely to happen. Most viewers who tune into the network do so for a sports fix, which they use an escape. I simply cannot imagine people refusing to watch College Game Day Saturday morning because of how this was handled by the network. Maybe I’m lacking vision in regards to this, but ESPN has such a huge market share, where else are people going to go?

I completely agree. I don’t mean to rule out that either one or several people could end up being fired for this if ESPN sat on legitimate evidence for 8 years; that certainly could happen. But I don’t think ESPN’s brands will be damaged. As I mentioned earlier, I’d love for ESPN to be thoroughly humbled somehow if their culpability merits it (still pretty early for anyone to pass judgment), but other than a minor shakeup somewhere, I just can’t see it happening.

the problem is, we’re still a generation away from people caring that much about the nuts and bolts of coverage. there are still too many folks that just want sports and don’t want to think too hard about them.
this generation (meaning yours mine) care more i believe. it’s akin to dumbing down in politics, and the age-old conspiracy about budweiser for the masses to keep them happy and drunk and not look too hard into how government and such works

This. I don’t mean the network crumbles. I do mean that some of the light needs to shine on this. Maybe it was appropriate, and there is a reasonable explanation. I was willing to accept that when both the P-S and ESPN sat on the story back in 2003 after looking into it.
This tape would seem to take that a bit further. It would be one thing if all you had was a guy who vehemently said he was abused, and no one else said anything. This is some serious smoke.
And if there was a conscious decision to hold this bit back 10 days ago, then someone needs to answer for that.

I tried this over the summer. As soon as we started streaming 100%, our internet connection became spotty and unreliable. I think Comcast puts up governors on high data users. I would’ve been ok with it, but my wife wasn’t happy, so we went back to DirecTV.

I can’t tell if ESPN attempted to talk to the wife and confront her with the tape when they first received the tape. Also, is New York a state that allows one party recording? It might be inadmissible as evidence.
P-S piece said they confronted her back then, she admitted her voice on parts of it (I’m sure the greeting and salutation and not the part where she says her husband prefers dick) were her, but also claimed it was doctored.

Would the fact that ESPN had a push in Syracuse and Pitt going to the ACC also play into this. Cuse and Pitt both wanted to leave after this season yet are being held to their contractual responsabilities. Now the Big East has not only a poor Football Division but also now has to deal with a scandal at one of it’s founding members and prominent basketball members. ACC takes no hit in this since this will be dealt with while still at the Big East.

I think that it is reasonable for ESPN not to spend the resources on verifying the tape when it was still only one person making the accusations. Then they get the new information and run with the story, and now they spend the money to verify the tape with what I imagine is better technology. I can buy that explanation.

It might not be possible to avoid ESPN entirely but it’s pretty easy to put a massive dent in your ESPN viewing as long as you stick to only watching the games. No pregame or post game or sportscenter and you’re down to maybe four or five hours of viewing a week.

We have a Roku, so we were streaming Netflix or Hulu, plus a laptop or two for general internet use. It was never an issue before, but when we started using it for a few hours a day, every day, it became worse and worse. Once we got DirecTV back, it’s been fine.

does the “no independent evidence to corraborate the story” line from the original reporting 10 days ago then trouble you? Or is it okay to say that if you had potential evidence but chose not to verify it?

If ESPN lawyers were telling them not to rely on the tape until it is verified then they can’t partially rely on it. They could have referenced the wife’s statements but how did that support the story?

ESPN stopped being about true about journalism when it did all of these rights deals with professional leagues, college conferences and the NCAA. We should not expect ESPN to pursue this kind of story because it would have required real investigative journalism.

After a second man said this month that he was also molested by Fine (that man is Mike Lang, Davis’ step brother), ESPN hired a voice-recognition expert who said the voice on the tape matches the voice of Laurie Fine. The call was made and received in states that don’t require both parties to consent to a call being recorded.

In defense of Boeheim, he’s known Bernie since Jim was an S.U. Basketball player From 1962-67. I’m guess he thought he knew this man very well, and assumed (never assume!) that somebody was pulling a fast one … Esp. Since Penn State’s debacle. I, personally, am very saddened by all of this. And the more news that trickles out, the more sordid it’s getting. Bernie’s wife is a real winner! She really ought to be ashamed of herself. And WHY did she stay with him? Ya can’t make this stuff up!
There’s something really weird going on with all of this. When the guy who made the tape first called Syracuse Police in the early 2000′s, they told him the statute of limitations had expired and there was nothing they could do. Now something really weird is going on between the current Police Chief and our D.A. The D.A. Is one tough Irishman, has been on the job a long time, and is very tenacious in “getting the bad guys”. And he blasted the Police Chief last week for discussing details of the case with the Feds and leaving him out of discussions.
Local news is just reporting that Pittsburgh law enforcement is on the case re the accusations of the third accuser.
Also saying that ESPN, the cops, the local paper, etc., did not release info about these accusations years ago because they couldn’ find any evidence or witnesses. They’re also saying that just because Bernie’s wife said what she said on the tape, doesn’t mean it’s true or proof.
All the major networks are here in Syracuse, waiting for news of the result of the police investigation.
