I’m not gonna pretend I’ve never driven borderline, but once you have kids/wife/family/responsibilities, I’m amazed people risk that. I got out of a speeding ticket once just by telling the judge we were being responsible and I was the designated driver (true, though no one in the car even had a drink yet)

We’ve had this discussion on here several times. Most states are implied consent states, if you refuse to blow, you’ll get blood taken at the station and in most states automatically lose your license for refusing the breathalyzer.

But you’re buying time for the alcohol to be metabolized by your body while they wait for the blood to be drawn. And, if a lawyer in PA is to be believed, you can use the GC (supposedly) method used to determine the amount of alcohol in your bloodstream as reason to throw out the results.

They had me dead to rights. With the evidence against me I was going to lose my license anyway. It did make it harder for them to impose mandatory counseling, after the fact, without a blood alcohol levels. I played the one crazy night card. I had a buddy blow .2 and he had to go to self paid counseling for a year.

you’re pretty fucked when you get pulled over for a dui now. maybe take your chances and pray you can get ok’d to drive to work.

Which is why I refuse to drive after having more than 2 drinks. Just not worth it.

Well, your licence will be suspended which is going to happen anyway if you blow and it comes back .08 or higher.

Well yeah. But people act (thanks to lots of “my buddy told me” urban legends) that not blowing is some magic ticket out of it when you’re actually driving drunk, which is about as far from reality as possible. Only slightly behind the “chug a bottle of vodka and throw out the keys as the cop walks out” story.

That’s what happened to my buddy in Kentucky. Implied consent was the phrase I couldn’t remember.
