1. Yes, there are increased penalties for driving “super drunk.” In Illinois, for example, if you blow over a .16 on a first time DUI, it’s an extra 100 hours community service (kind of a joke. If you blow over a .16 on a second DUI, it’s a mandatory minimum 2 days in jail and minimum $1,250 fine, plus an extra mandatory minimumm 5 days in jail or 240 ours of public service. Third timer with a kid in the car, $25,000 fine.

2. The really close to .08 blows are far more likely to get reduced to a reckless driving or other lesser offense. But you are correct, blowing over is blowing over. It’s really more of a mitigation factor.

Walking home from a formal at PSU to change so I could go back out (didn’t want to goto a bar in my suit) I tripped while drunk and fell in some mud, so I had mud all over my suit, wasn’t paying attention when I got to my building, got off on the wrong floor and went to the apartment that was below mine, walked in the unlocked door, down the hallway to my bedroom, opened the door, and realized I was in someone else’s apartment. Luckily nobody was home, but I realized later that four off the boat Koreans lived there and I wish they had been home because a drunken mud covered giant guy in a suit busting in on them would probably have scarred them for life.

I also left out the part where I was walking through neighborhoods and tripping over garbage bags of grass clippings. More than once. The next day my body looked like I had been in a fight.
