Roger Rebuked: Paul Tagliabue Vacates All Player Discipline in the Saints’ Bounty Case
Paul Tagliabue has issued his ruling, per Greg Aiello of NFL PR, in his review of the Saints players’ appeals of the Bounty suspensions, after Roger Goodell recused himself. According to Aiello, Tagliabue affirmed findings of fact regarding Anthony Hargrove, Will Smith, and Jonathan Vilma, but vacated the punishments imposed. Tagliabue’s comments, per Aiello’s Twitter account:
“Unlike Saints’ broad organizational misconduct, player appeals involve sharply focused issues of alleged individual player misconduct in several different aspects…My affirmation of Commissioner Goodell’s findings could certainly justify the issuance of fines. However, this entire case has been contaminated by the coaches and others in the Saints’ organization. Having reviewed the testimony very carefully, including documentary evidence that is at the center of the conflict, and having assessed the credibility of the four central witnesses on these matters, I find there is more than enough evidence to support Commissioner Goodell’s findings that Mr. Vilma offered such a bounty (on Brett Favre).”
Let’s read between the lines here. First, there is no mention of Scott Fujita, a labor leader within the NFLPA and a harsh critic of Goodell in the past during labor negotiations. Why not? We’ll soon find out.
On a broader level, Tagliabue found a bounty program to exist. He found evidence that the players mentioned were involved, and mentioned Vilma. When he says “this entire case has been contaminated by the coaches and others in the Saints’ organization,” though, he is finding that the actions there were more severe and institutional. Not good for Sean Payton, and not good for Mickey Loomis. He basically says there is evidence that the players did something, but the problem came from the top.

Vilma stating through attorney that he is still pursuing the defamation lawsuit. Not sure how this will help his situation. So he may, and I stress may, get some respect back but Tags states that there is evidence that he put a bounty on Favre.

Vilma has acted like a real blowhard at times about this. I don’t think he knows the difference between fact and circumstantial inferences. I’m sure he’ll somehow see this finding of guilt as a victory and proof of his innocence, based on the affect on his suspension.

I always believed this was just a PR story that would allow the NFL to stay in the news during last spring’s offseason.
The NFL has its own 24 hour network trying to get into homes and add subscriptions.
They also know that anything NFL, true or untrue, will lead on the four-letter network.

I have no doubt that is what it is. That then leads one to question whether it was a vendetta by Roger to include him, given Fujita’s past criticism on safety issues as a NFLPA leader.

Albert Breer now reporting on NFL Network that since HGH testing is still not resolved in the CBA, no player punishments are final and that the player union can reopen the CBA since it is not finalized do to the HGH testing and go after Godell’s power in enforcing punishment.

I used to think that but don’t really anymore. JMac really does take a bunch of shit, pretty much all the time, and very rarely respondes. And when he does he usually at least attempts to do it with a joke at first (this case is a bad example, but usually). I’m pretty sure I wouldn’t stay as above the fray as he does most of the time. He’s also pretty good about responding to legitimate criticism and/or questions.

I’ve always been under the impression that the NFL wanted the defamation case to go away desperately for fear that discovery in federal court would require the NFL to produce what has appeared to be rather flimsy evidence against the players. At least to date, it appears that everything the NFL has produced has drastically overstated their case – game logs for games not played on the dates indicated, affidavits recanted by individuals who allegedly made the allegations, video not supporting alleged comments, etc.
Tactically, could Tags have rescinded the punishment while upholding the findings because the NFL can then say, “see, there was basis to our claims”, while at the same time file for summary judgment on the defamation claim because there are no “damages”?

I’ve heard he’s ever entertaining on Twitter. But one day, for reasons I never understood, he went after Jason and said some pretty awful and racially charged things. Paolo never really “attacked” anyone per se, though he was convinced that crackerjack was a man and every time she referred to her husband Paolo would say she’s not a woman but a “fucking homo”. Most of what Paolo did was leave long rants at the end of comments that were in some cases filled with racial and sexual epithets. He could be funny at times due to how ridiculous some of what he said was, but I’m honestly surprised to this day that Jason allowed him to be here as long as he did.

The organization and the coaches threw so much shit in the air that no one could make heads or tails of it — except for the fact that Vilma clearly put that bounty on Brett Favre. So the suspensions of Payton, Loomis and Vitt and the loss of draft picks is still kosher. I got it right?
Where’s the 50,000 pages? Where’s the affidavits that were signed after the fact? Where’s all that footage from Sean Pamphilon? The league spent the first half of the year telling us it was an open and shut case. And now it’s a lot of hot air and overblown events — but there was something bad all along, trust us on this one. I’m biased, but I feel the same way about Spygate… especially now that it’s clear Goodell is a power-hungry madman, I think it’s somewhat discredited. Someone made a youtube video that I watched skeptically, but it actually made a few good points about the details on what happened, and why it wasn’t as big a deal/advatnage as ESPN and Gooddell would have you believe.

I’m willing to accept some of what was reported in both cases. I do think they got blown up big time by the league and its media partners because a big story like that helped Goodell show he was the tough new boss everyone had to bow to.
