Alabama Teabagger Plea Bargain: Up to 2-Years in Prison For LSU Fan Assault

Brian Downing, 33, the Alabama fan who “teabagged” a passed out LSU fan at a Krystal Burger in New Orleans following the 2012 BCS National Championship game, agreed to a plea bargain today. Downing, who was facing charges of sexual battery and obscenity, will not be required to register as a sex offender. He has however agreed to a two-year prison sentence. From nola.com:

He would have faced as much as a 10-year sentence and been forced to register as a sex offender if he were convicted on the sexual battery count.

He had earlier rejected a similar deal, but had a change a heart on the morning of trial.

Downing gave one-word responses as he answered questions from the judge about whether he understood the deal. His parents sat quietly in the gallery.

“I believe while we felt we had a strong case at trial, which we did, the fact is, if he lost he’d have to register as a sex offender,” Kennedy said after Downing’s plea.

“He has a one-year-old son. Is it worth the risk of never seeing a little league game or dropping your child off at school? He decided no.”

Downing was celebrating Alabama’s 21-0 win over LSU in the national title game.
