NCAA Forced To Hand Over All Licensing Income Information in Athlete Likeness Lawsuit
The class-action lawsuit against the NCAA over licensing rights is ongoing. Athletes suing scored a substantial triumph on Monday. A judged has ordered the NCAA to reveal all its members income from outside sources, including but not limited to television, radio, Internet, ad sales, sponsorship and licensing agreements. This will let the plaintiffs calculate how much profit NCAA member institutions are making from the clause that forces student-athletes to sign over likeness rights in perpetuity.
The plaintiffs in the case have been pushing for details about the NCAA’s income from media sources for quite some time. They say they need it because it “may form the basis of a calculation of damages” and “demonstrate the magnitude of the benefit that the NCAA and its members receive as a result of exploiting the name, likeness and/or image rights of college athletes.”
Setting up a “pay the players” straw man and defeating it is easy, but in reality it is a multi-faceted issue. Outright payment, however justified in theory, won’t work in practice. Even if NCAA members were willing to fly commercial occasionally to accommodate the expenditure, it would create too many problems with Title IX, college athletics’ tax exempt status and potential workers’ compensation claims.
Two reforms will work. One is already in the process of getting approved, covering the full cost of attendance for student-athletes. They should be able to eat, buy gas and function like people. Major athletic departments can more than afford to cover this cost. They are cash-strapped by choice. Where does the expanded television revenue go? Thus far, increased salaries for coaches, assistants and administrators and new, in many cases, unneeded facilities. Assuming every scholarship-athlete is on a full scholarship, covering COA (under the $2,000 plan) would cost Michigan about $940,000 per year. That’s less than one percent of Michigan’s yearly athletic revenue. Michigan could fund that for the next 35 years out of its present operating reserves.
The other is reforming the definition of amateur, which is at stake in this lawsuit. When Michigan put its Alabama game jerseys on display, Denard Robinson walked up to the mannequin wearing No. 16 and untied its shoe. To any reasonable person, that No. 16 represents Denard Robinson. To the NCAA there is no connection whatsoever. Michigan happened to choose No. 16 to produce (and sell out of). Schools, conferences and TV networks manufacture and sell stars. They use them to make millions off the field and, unlike any other walk of life, they are not compensated for it.
A switch to the Olympic model, where student-athletes can’t get paid directly but can accept outside endorsements would be fair, and come at no direct cost to the schools. Matt Barkley can sell Subway sandwiches and capitalize on his stardom. Average player for Alabama can have his picture put in a display window in exchange for a free suit. The NFL-bound player from a poor background who wants to stay for his senior season can do so. The NCAA can also offload much of its enforcement burden on the IRS.
This would also help out the NCAA’s Olympic sports. We’re not sure what the marketplace is for NCAA track and field or college swimming rights. We are sure it is probably far greater if Grenadian gold medalist Kirani James does not need to stop competing for Alabama in NCAA competitions to get sponsorship and Missy Franklin does not need to forego competing in college because the endorsement money was too much to turn down.

My first thought when reading this line and then the post was that you’re wrong and this is boiler plate class action discovery procedure, the NCAA was never going to win this argument, revenue disclosure is almost always given up for the purposes of damage calculations.

wouldnt mind the NCAA cracking down on what college golfers can receive…then again, it’s not really their call, it’s the USGA’s and R&A’s. still really pisses me off that someone with that kind of access and facilities and rescources at their fingertips THAT THEY RECEIVED SIMPLY BECAUSE OF THEIR TALENT AT GOLF are still considered amateurs.

Another option is to effectively “unionize” the athletes by having them opt in to a trust that allows their likenesses to be sold en masse then split the revenue. Basically what NFLPA and NBAPA, et al, do now

I have no problem with “cost of attendance” scholarships, but let’s not act like student-athletes aren’t living like normal college kids and are having to struggle to get by. I went to school with some of the poorest football players around and they did just fine with what they had…which by the way was roughly $100k more in value than what I had and people less fortunate than me had.

I think the endorsements should run through the athletic department, with the athlete getting a licesing fee for use of their likeness. But I agree they should be compensated for this but not “paid” through the athletic department.

Also, there is no way a court will rule in favor of a school’s jersey and number being a “likeness” of a player. What’s proprietary there for the player? A number? A color? A fabric? The combination? Do you want athletes to have full cost of attendance covered? Or do you want the NCAA to realize smaller profit margins. Here’s one opinion, take it FWIW. I’ll try to be brief (yeah, sure).
She wants/needs to know you’re consistently responsive to her concerns. On the other hand, dip isn’t illegal.
You could make it a tug-of-war over who gets his/her way in this case. You could win the fight (keep chew in your life) but lose something bigger (your wife, or at least some level of her support).
One challenge is how do you maintain your ability to choose how you conduct your life versus the willingness to cooperate with your wife for the sake of a cohesive marriage.
You don’t want to roll over in every case for the rest of your life, but you don’t want to be a stubborn mule every time she asks you for support on an issue.
Bottom line: you and your bride gotta have a long talk, come to a consensus, then both of you stick with it.

Right. Scholarships for the sports no one attends would go away, and ultimately those sports might go away, too. Most of those athletes get very little anyway. The baseball team might split 8 scholarships among 25 guys, for instance.

Revue generating athletes are forced to donate 100% of the income they generate for the privilege of living on the land and a chance at becoming an apprentice. While generating this income for others their likeness rights are used to generate additional income that they have no access to.
While the swimmers if good enough can declare pro as teens football players must support the system, basketball players can leave the country if they want a chance at being paid market value.

I think from what I wrote it is pretty clear. I would agree with colleges directly paying athletes but I think that is a non-starter. I would pay every scholarship athlete an addendum to cover the actual cost of attendance. I would give every scholarship athlete the opportunity to pursue endorsements which could be regulated pretty simply along the Olympic model. What’s the confusion?

The schools would lose money on this. Nike isn’t sponsoring Iowa Football if James Vandenberg is doing endorsements for Adidas. Furthermore, the school would get that endorsement money outright over the player under the current model.
There’s already pressure for amateur athletes to make grades while performing at a high level. You start putting money in their pockets and those expectations go way up as does the criticism when they fail to achieve desired goals.
Stop trying to make amateur athletics into professional athletics. They are two different things.

False. Nike sponsoring Wayne Rooney does not stop them also sponsoring Manchester United.
The only difference in coverage, compensation, revenue etc. is that the labor isn’t compensated.

Well yeah, I mean that seems like it would be something the NCAA would consider because it perpetuates the myth of the “student athlete.” Seems a possible realistic way they might approach it.
If a full time student is receiving financial aid above the cost of tuition to meet the full cost of attendance, and drops below the necessary hours, they have to pay the financial aid back. I could see them using that logic to get money back from players who don’t graduate.

Do away with all athletic scholarships. Let the pro leagues develop minor systems
I’ve thought this many times. NFL is powerful enough that it COULD in theory start a minor league for NFL prospects out of HS.

What’s the benefit of that though? They let an organization detached from them generate the players that make them money at zero cost to them. If they take over that they’re suddenly on the hook for a shitload more overhead in terms of infrastructure and insurance costs.

I see this as part of the problem whereby athletes who would already have turned pro are forced to submit to 4 years of nonsense instead of making 60 million since starting at 18.

None to the NFL. Except for maybe being able to develop better QBs instead everyone that comes out now being a spread QB. I would imagine it wouldn’t hurt the Universities too much either.
