Four Penn State Trustees File Desperate Appeal To Lift NCAA Sanctions
Four Penn State Board of Trustees members have employed legal counsel and are appealing the NCAA’s sanctions against the Nittany Lions’ football program. The perfunctory appeal is a prelude to a federal lawsuit once the appeal is dismissed. As with the Paterno family, the act is desperate and the premise is flimsy.
The rogue BOT members are appealing for four reasons.
(1) They claim the PSU president did not have authority to agree to the consent decree.
(2) The NCAA violated purported “due process rights” in this case.
(3) The Freeh Report is invalid and, in places where it may not be invalid, does not violate NCAA bylaws.
(4) They believe the sanctions are excessive, unreasonable and harm those not involved.
Working backward. NCAA sanctions almost always affect the innocent. Claiming the sanctions are excessive or unreasonable is untenable, as it is impossible to quantify the crime within an NCAA framework. Is conspiring to cover up a child rape only a two-year bowl ban offense? Such a discussion could more easily flip and suggest the NCAA did not go far enough.
The Freeh Report made no claims to be a legally binding document. It was an investigation without subpoena power, intended to piece together what happened based on interviews and documentary evidence. Penn State commissioned that investigation. Penn State’s president and BOT accepted the results. There’s only a point if vague whining is replaced by specific, tangible and consequential flaws.
No “due process rights” exist within the NCAA. It is a voluntary membership organization. Emmert had the authority of the organization’s board of directors and by proxy the entire membership to act. That was all that was needed. Some semblance of due process would have been helpful and set a less troublesome precedent, but it was not required (no matter what general rights a former Navy Seal believes he fought for).
Any argument rests on the consent decree. Did Penn State president Rodney Erickson have the authority to approve it? He believes that he did. The NCAA believes that he did. Penn State’s BOT met, reviewed and expressed support for Erickson’s actions. Those facts should, regardless of individual disagreements, quash any NCAA appeal and potential federal lawsuit.
The only way the NCAA will remove the sanctions is of its own accord. Few would suggest that as even a realistic possibility, unless desperate to lure and keep players. The sanctions are staying. So what can we conclude from this mess? Besides some pissed off people having the wherewithal to hire attorneys to draft documents?
Penn State had a communication breakdown. (Shocking, I know.) Mark Emmert’s letter to Erickson in November 2011 spells out nine constitution articles and bylaws Penn State may have violated. It expresses the NCAA’s determination to investigate and act and asks for a response within a month (already dispensing with formal channels and customary time frame). NCAA action was delayed to let the Freeh Report finish. Either Erickson did not grasp the full ramifications of that letter or he did not communicate it effectively to the rest of the university. No one in the Penn State hierarchy should have been blindsided by the NCAA punishment.
The NCAA’s action was ineffectual. Sanctions will prevent Penn State’s football program from competing for the next decade, but the stated purposes for the punishment were to serve as a deterrent and to forcibly break down what had become a corrupt football culture. The first goal was already covered by moral abhorrence, criminal prosecution and an incoming civil suit. The second goal has not been accomplished. The punishment has only fortified the irrational “We Are…” mentality with fans circling wagons. Rather than assist a sober reflection and resolution to this crisis, NCAA punishments have redirected attention toward football and created an active impediment.

Seen an awful lot of lawyers say they have quite a bit of clout with their due process claims.
Despite siding with some of the opinions of the authors here, I still see an agenda laced within every piece of coverage this website has offered on Penn State since November ’11. It’s extremely unbecoming.

But was anything the NCAA or Freeh or anyone else did to Penn State going to help in sober reflection/resolution? Ultimately that all falls to the people within PSU — the BOT, President, student body and alums. And throughout this whole ordeal, they’ve given no indication that they see the problem as systemic. To them, it’s one rotten apple (Sandusky) who used their system to get away with horrific crimes that the rest of the system had no idea were occurring.
Punishment only works towards resolution if the guilty admits his guilt. Penn State hasn’t (and I doubt they’ll ever) admit guilt of any kind in this situation.

You lost me here. While you’re correct — and Freeh even made a point to reinforce that fact — it was treated as such by the media and ptichfork crowd, then used by the NCAA as if it was a thorough, binding investigation.
If the report is flawed — and I believe that it is, greatly — then the NCAA is on the hook for using it as the sole basis for their sanctions. I doubt the NCAA will grant the appeal, but I think both this and the Paterno suit will have merit in court.

What do these trustees see the outcome as being? From all reports, Emmert convinced the NCAA president’s panel to accpt the scholarship reductions etc., that ended up in the final punishment. The prezs were pushing for the death penalty.
All in all, assuming the trustees win, things will get worse, not better.

I dont think PSUers believe that Sandusky is the only one to blame. Not at all. Wagons are being circled precisely because the NCAA decided to kick PSU in the face while it was down. State College would have accepted the fine, probation, minor scholarship reductions and probably a two-year bowl without complaint. People there got pissed when the NCAA lost its mind.
Also, I’d disagree that the problem is systemic, as well. If it is, then half the universities in the country are in that same boat.

I don’t really see how this compares to the Paterno family’s filing. If the university president truly didn’t have the authority to act w/o board involvement (and I have no idea if that’s the case, nor do I accept that it is based solely upon with the president and NCAA think), then the BoT has every right to act.

This was the weirdest part for me. I know this was an unprecedented event, but usually sports leagues do their own investigations into these things, and not trust some outside source that was hired by the university.

Not really. If the NCAA/PSU president is found to have acted improperly, there’s no way they can turn around and say, “Well, fine, here’s a four year death penalty instead.” There would be a mutiny. PSU would take them to court again, and the entire system would be on the verge of collapse.

I guess I’m part of the “them”. I do not think that Penn State has a systemic problem in regards to sexual abusers. I think it was one person, and the failing of a small handful of people, that made it so. The rest of your PSU group (BoT, students, alums) didn’t have any idea these crimes were occuring.
Just because the NCAA believed Erickson had the authority doesn’t make it so.

From the outside, the general response of many PSU fans has been very off-putting. It seems like they have assumed a bunker mentality that prevents them from seeing the bigger picture. That being said, I don’t see any other major D1 program responding differently to the same scenario.

My point was that the NCAA’s punishment (as well as much of the coverage of this case) considers that Sandusky got away with it because there were systemic problems at PSU — that it was more than just 2 or 3 persons in power hiding him. To them, the entire infrastructure at PSU flowed from Paterno’s dictatorial hold and allowed for Sandusky to be shielded from repercussions.
If you subscribe to that idea, then what the NCAA handed down is fair. It’s a wrecking ball to a corrupt system. I’m not saying I subscribe to that reading of things, but that’s how some see it — most notably the NCAA.
The problem going forward is that even if PSU wins some sort of legal battle to have the accepted sanctions overturned, the damage has already been done and PSU just continues to look like they’re arguing semantics. After all, those civil lawsuits will be arriving shortly. The juxtaposition of Trustees fighting in one courtroom while rape victims are suing them in the next will not be a good look.

Paterno doesn’t matter much to me — taking away wins was petty and moronic, and I don’t believe he allowed Sandusky to rape kids just so he could continue coaching football — but I don’t care that a statue is down, either. Had to be done. At the same time, it bothers me that a corrupt, ineffectual NCAA is spitting on a wounded school just to make themselves look better. Irritates me on principle, and I’d like to see them get hammered in a real court because of it.

I’ll start by saying, I thought the NCAA sanctions were out of line.
That being said, Penn State was OPENLY looking at a 4 year death penalty. (Now, I’m basing this on ignorance, because I haven’t researched it) Should Penn State WIN and the NCAA investigate, they’ll hit the holes that the Freeh Report left open. They’re attorneys, and most the NCAA’s investigators are damn good attorneys. If they find MORE evidence of a coverup, or more evidence of wrongdoing. That death penalty hammer could easily come back into play.
You have to weigh your options as a school. Simply succumbing to fan demands isn’t always smart.

Honestly, I feel like the NCAA should punish the school and team if they want to. What I have a problem with is that they used the Freeh report to do so. One, it was designed with a very different purpose in mind. The goal was for the BoT to get a report on its (board and admins) governance failures and a recommendation of remedies. Two, I think it drew some very broad conclusions from evidenence that was scant, highly circumstantial and oftentimes contradictory of the conclusions.

I personally don’t think the NCAA did enough. They shouldn’t even be on TV this year. Since they are, every dollar they make out of the BIG10 network should go to the kids that the university fucked over to protect a program.

Yeah, the next time someone thinks about doing this, it will be the bowl ban and not the felony jail sentence that acts as the deterrent.
The university was punished long before the NCAA stepped in. But since you’re asking, I’d have accepted a $30M fine, two-year bowl ban, and five scholarships less a year for three years. That’s fair to me. Don’t care about the wins either way. If the NCAA wants to pretend Paterno didn’t win those games, fine. He did, just like Bush won the Heisman and Michigan was in the Final Four.

It’s not uncommon given the circumstances. In this case, PSU wanted to ensure there was no image of impropriety. Hiring the Freeh Group (an outsider) and giving them unfettered access allows them to say there was no undue pressures from insiders to hide anything.

Erickson is the President. For all extents, the CEO of the Corporation. If he ran it past the BOT and they didn’t oppose it when he brought it to them, he can say that he was empowered to take the deal. It’s up to the BOT to have stood up and said “HELL NO!”

While the court in Tarkanian v NCAA focused heavily on the voluntary nature of NCAA membership, it also dealt heavily with whether the NCAA would be deemed a state actor. If it was, they’d still have to follow due process.
Even then though, having read the notice of appeal, they’re speaking to internal procedures focusing on the fact that the NCAA conducted no investigation on its own.
Tarkanian was a 5-4 decision. I would not be the least bit shocked if this ends up before the SCOTUS and we saw a new standard for the NCAA laid out by the court.

Nah. In fact, that’s what bothers me the most about this Freeh Report. It bought a lot of other guilty parties — Second Mile, the BoT, the DA’s office, DPW, Tom Corbett — lots of time to fire up the shredders. Which is what I believe it was designed to do: push blame on a small cadre of conspirators while the rest mop up the evidence trace.
I know that sounds rather foil-hatty but I’m not generally a conspiracy guy. Everything from the rapid nature of the Freeh Report to the blind acceptance of insane penalties just reeks of a deeper cover up to me.

That said, your scenario is different because you were the criminal. Penn State University is an institution. It didn’t rape anyone. Even if you break it down into entities, the tens of thousands of students, faculty, admins, etc knew nothing about this. Yet all those people took the hit.
If there was a direct culprit then I think they should be punished (and they are in this instance). Otherwise, unless the football team broke NCAA rules, the NCAA had no recourse to act.

I’m kind of talked out on this subject, and frankly, no matter what tact you take, you are either portrayed as condoning child molestation or punishing a bunch of innocent people (current students and athletes) who had nothing to do with the actual wrong doing. Nobody is “winning” any of these arguments and they have all become tiresome at this point. Just my opinion, but I think the NCAA’s punishment, especially once Curley and Schultz are in jail, is going to viewed as over reactive.
I’m kind of glad football is going to be played soon. Good luck to these Trustees. If that’s how they want to spend their money, knock yourself out.

I think Second Mile knew Sandusky was a pedophile. And I don’t mean like Paterno where he had an idea that maybe Sandusky was inappropriately fooling around with kids. I mean, I believe people with Second Mile knew Sandusky was raping kids. I also think Tom Corbett – now PAs governor – had more than enough to prosecute Sandusky and didn’t because Second Mile filled the campaign coffers.

Why let him come around the program? That’s the single worst action you can take if you want to hide a molester. “We won’t tell on your because we want to win football games and protect the program, but here are keys and an office on campus. Do whatever.”
It makes no sense. None whatsoever. Same with Paterno bringing this to Curley and Schultz. If he wanted to keep it quiet to catch Bowden or whatever, why say anything at all? The scandal that would have erupted if it came out in 1998 or 2001 that Sandusky was raping kids in the football showers could have ruined Penn State’s football brand. I do feel like the punishment was probably too harsh, but I’m not sure Penn State is really has any place to complain about it considering what went down there. All I know is I’m going to be giddy as a kid on Christmas when Michigan runs out of the tunnel on Sept 1st. Yes and no.
I mean it raised money for the Port Authority like it was supposed to do. Money which he then withheld from the Port Authority because they refused to restructure their labor setup, which was what was making them unsustainable.
Now that the feds refused to let the state put tolls on I80, we’re about six weeks out from the Port Authority eliminating half its routes and employees.
It worked to raise the money, but in the long run couldn’t save the Port Authority on its own.

Paterno and PSU would have been held up as an exemplary standard for how to deal with a crisis situation. Its hard to admit that now after Paterno is seen as a leper. But in 2001, that guy would have been knighted for turning Sandusky in.

Of course none of you will be smart enough to realize that there are a lot of current and future insurance/bond rating/loans/etc repercussions regarding the entire “thing” from civil litigation, ncaa sanctions, to the criminal cases of its former employees. The need to present certain “facts” in cases and have them legally documented can and will go a long way when it comes to getting D&O Ins, heading to Goldman for another bond issuance. Don’t have time to read the bulk of these comments, especially after the first 15 or so. What did I miss? The prez, AD and head coach covered it up. This should be considered systematic. The top 3 leaders of the school, whether they should be or not, may not have been able to do much in 98,but they did a couple years later. The BOT owns some responsibility in allowing these individuals to grow this kind of power. Everyone should be held in check and the BOT failed. The rest of penn state should be holding their leadership accountable.
With that said, the BOT should be thrown out. They clearly missed the point.
