I grew up in the town where that accident video is taken. What makes it worse is the guy he hit is coming up an incline from under a railroad bridge with the McDonalds as a blind spot, he never had a chance to see this idiot running the red light. Independent Agents are still representing the company. They might not be direct employees but they are held out as representatives of the company and their actions bind the company. Whatever economic and legal advantages a company has for using independent agents are balanced by the fact that you as a consumer can seek damages from the company for the acts of their agents.

If a bank uses any outside agency for part of their process then they are responsible for what they do. I have to report monthly on crap mortgages we have to buy back from 5 years ago. Companies that are no longer in business, because they closed shitty loans mostly, are long gone but because my company used them we have to pay. It’s the main banks fault for lack of due deligence, and the excuse was everyone was making money, they are paying the piper now. All the banks are.

i agree, smoking in private residences is the owners choice. in apartment buildings, if the building owner wants it smoke free they can do that if they want.

That is a risk that large companies take on when they employ independent agents to do 20-40% of their business for them. They are acting as Wells Fargo employees as they write business for the company.
If Wells wanted to make sure this wasn’t happening they could have done a multitude of things including:
Hire more Direct agents, who do work directly for the company.
Have a better audit program of independent agents and how they perform their business.
Or, have their underwriters actually do their job (instead of placating to the company’s wishes) and find these problems as they come across their desk.
This is a perfect example of a company being too big for its own good. They want the revenue brought in by the independent agents, but didn’t set up the infrastructure to properly review what that group of agents was doing, either singularly or as a whole.

And this has been proven by the economic effects of smoking bans (restraurants in the 2-5 years after smoking bans have had 10-12% higher revenue, which in turn leads to more tax money). And the less smoke, less potential second hand, which in turns lower health costs. It’s a win-win economic argument. But big bad government taking away our rights…

No, people need to show moderation and that’s self discipline. Public health is different that private health, hence why I’m not keen on the soda ban. Smoking in contained spaces is public health, and government has a right to regulate that since it can lead to increased costs on their end. Recently moved to DC and am trying to find the best spots in the area to run. Anyone here know of some good places to check out?
That depends on where you live. Inside the district? I don’t know much but I think there is a public court near East Capital ST.
In VA, Duke street by Harris Teeter, Old Town off of King, and Rt. 1 near old town have some courts, but it is hit or miss. If you have a little money, the Sport and Health Gyms in Alexandria and Mclean and Silver Spring have gyms and constantly have pickup games going on all the time.

Even when i was a heavy smoker I was ok with not being allowed to smoke in certain establishments. It kept me from chain smoking when I was out drinking and ultimately helped me start the long, difficult process of quitting.

While Augustin is certainly worse than Collison, he’s still a decent backup, Mahinmi is a huge improvement over the Hansborough/Amundson combo, and while you might worry about Green’s motivation, he can provide a viable offensive option off the bench. I like this team.

But at the end of the day do I really care about JoePa, Sandusky or the victims? Nah, not really. Didn’t care when the accusations came out, didn’t care about the trial and it wasn’t my ass getting slap-slap-slapped in the shower. I don’t need to sensationalize it to sell mags. I smoke one, maybe two, butts a week, so smoking bans have no effect on me personally. I can’t get over, however, how some people can support the government dictating how private business operate just b/c they don’t like smelling smoke while they’re out getting shit-faced.

Did Freeh have Subpoena powers? Not like he could interview like he would if he was a law enforecement person. Also, I think it was a University report, so not sure why Paterno family members not employed would be interviewed. It’s an outside person brought in to compile information, and give a broad assessment. I don’t think this is the end of the matter for PSU, they have to start somewhere.
An odd note, if PSU wanted to minimize damage, I dounbt they would of had the report come out one of the slowest sports days of the year.

We just passed a smoking ban here in Indianapolis. The idea was wildly popular in the community, yet before the ban, not a single bar in my area was smoke free. For those “no regulation, let the market correct itself” people, how is it that the idea of a smoking ban in bars could be so popular, yet not a single bar make the decision on their own to ban smoking? It seems when the market fails, it’s perfectly reasonable for the government to step in.

Personally, I like to read between the lines and reading between these lines there are still a lot of things that simply just don’t add up. One “independent” report by a questionable character individual. In 10 years when someone like Pearlman has spent that time researching it and writes his book I’d personally put more stock in that than Freeh’s report.

I have thought the same thing. Shit like this happens more frequently than it should, and we always challenge it in those cases, but we can’t say anything this time? There may very well have been some improprieties that we don’t know about. When the other guys get charged and go to trial, i find it unlikely that we learn ZERO new evidence or one of them doesn’t start adding people to the fire with them. Not saying it will, but I just don’t see how the Freeh report includes ever exacting detail. Does that make sense?

Penn State is certainly open to ‘suits, but at the same time – at least in my mind – a report pinning people that were terminated, etc., the second this thing broke wide open those people were cut loose. From there Penn State has done what they can to aid anything in any way. I think that’ll carry some weight in sort of shifting blame around. Again, they’re still going to get sued, but they can play the PR game of ‘we didn’t know and when we did we went after them’.
As you said, more will come out, and I hope it does. Personally, I say I don’t care because the thing does disgust me to the core. That’s why I say I don’t care – because I don’t want to, I just want to be done with the whole thing. But I do care. I care about the kids who for some reason put up with this. I care for his own step children that were abused by someone that should’ve been anything but a predator to them. And I do care about Paterno’s legacy — only in the sense when I have kids I want to make sure that when I’m asked about him I can truthfully hammer him for being a terrible person, etc. His name isn’t leaving the record books, etc., and all of us one day are going to have to explain this to our kids and I just want to make sure when that time comes the truth is out there – however negative or ‘positive’ (as if that could happen in a case like this) it may end up for Paterno.
All that said at the end of the day I do take solace in the fact that the real predator here has been identified and is getting his at a pound me in the ass prison.

The reason to argue against smoking bans isn’t because the government shouldn’t interfere in private business because it does all the time and if it didn’t and we all acted in our self interest all of us will be worse off.
The key is to argue why in the particular case of smoking in restaurants the government should not interfere. A general argument against govt interference is retarded.
You realize its government interference in private business thats stopping a coal plant from popping up next to your raised ranch and pointing the smoke stack at your master bedroom window.
