Freeh Report Fallout: Could Penn State Be Shut Down by the Department of Education?
The Freeh Report has been a crushing blow to Joe Paterno’s legacy, as many expected. Depending on what media reports you read, the NCAA could get involved based on Louis Freeh’s findings. What might the big-picture fallout be?
John Infante, a smart writer who ran the Bylaw Blog and knows the NCAA as well as anyone, tweeted some thoughts about the Department of Education possibly getting involved. Could the DOE prohibit the school from receiving financial aid? And before you jump in with, “but why would you punish current students who had nothing to do with that?” Infante has already responded to that: If that’s the case, Penn State is Too Big to Fail.

There are always private loans… These days you usually get better interest rates anyway. The one perk of federal loans was the interest subsidized loans which appear to be going away shortly.

I can see the argument about the football team being shut down (not that I agree with it), but now punishing STUDENTS?!?! Come on. Patently ridiculous. I don’t know the answer, but I know the answer is not stopping a kid from going to a college he/she may have dreamed of and had nothing to do with any of this.

My guess is that PSU gets a HUGE civil fine for the Clery Act failures, as the campus wide plan was not even in formal effect yet.

Could the DOE do as Infante claims? Sure.
The question becomes what is gained by this? Punishing PSU? Taking away the football program is just as big a punishment without destroying the university. To say nothing of the large number of students who’d find themselves out on the street, hoping that another university would take their credit hours. Or of the thousands of professors, research assistants, faculty and staff who would like join in major class action lawsuits against the DOE — if I’m a tenured professor, I’m getting my money one way or another.
Don’t see it happening.

And if the DoE does shut down Penn State here are the repurcussions:
-80,000 students would be forced to find private student aid or have parents pay for the most expensive in-state school in the country (In-state tuition+board $19k, Out of state: $34k). Or they would be forced to find a different university which is damn near impossible
-If the University were to go bankrupt, the state of Pennsylvania would go into immediate recession, causing massive political repurcussions (esp. for a DoE which is currently under Democratic control), potentially swinging the 2012 election
- Massive brain drain in the commonwealth of PA
- The loss of thousands of jobs, research grants, etc.
It’s a stupid idea that will destroy PA

As of right now I’d say absolutely no to shutting down the school. However, if there is an investigation into the Second Mile and it shows some of the cover up was because of business PSU and the Second Mile did together(land purchases, a retirement home second mile helped fun on psu property, and so on) then I think the DOE needs to look into their options. As Lester Freamon would say follow the money.

This strikes me as an incredibly ignorant opinion to have. And it strikes me as the opinion of someone unfamiliar with institutions of higher learning. Penn State isn’t a school… it’s an institution, with a medical school, and hospital, among many other schools. You are going to say “PSU gets no money” then randomly start drawing lines?

And this part is actually incorrect. Graduate Subsidized Loans are going away, but undergraduates will still be able to receive them and at the lower 3.4% interest rate that was in place in 2011-2012.

Stop with this bullshit. I hate penn state. I have kids. I think the suggestion of shutting down the school is ludicrous. This is more hyperbole than linsanity winning the MVP.
It was horrendous. Those involved should be severely punished & shamed. The school should pay substantially in civil court/fines. But shutting down the largest institution of higher education in the state of Pennsylvania and removing it as an option for thousands of innocent current and future students… REALLY?!?!

If they do anything, the DOE is probably going to levy a huge fine on PSU. Nothing will happen to current students.
The football program COULD potentially face a more substantial penalty which could ultimately force them back into Indiana and Minnesota territory

Penn State actually used to use a private lender as their preferred lender. They went bankrupt. So they switched to Direct Loans (the government’s lender) in 2007.

Starting to think there should be a Football penalty. Hear me out:
1. Had Football been less idolized at PSU the crimes would have been reported. If Sandusky was a former tennis coach he would have been arrested over a decade ago.
2. Football as the most important thing superseding the morals of the athletic institution at the highest level.
3. NCAA needs to take a stance that sports are less important than the education institution themselves (even if not true).
4. To do nothing would encourage corruption for short term success (which is already a huge problem in the NCAA).
10 year Bowl Ban and the players are free to transfer without forfeiting a year. I do not want current players generating revenue to pay for civil lawsuits against the failure of the previous regime.
NCAA should look to the courts upon conclusion to see if any additional penalties should be applied.
PSU as an educational facility should not harmed in any way.

UPMC is second in the state behind Walmart now according to UPMC.
PSU is the largest employer in Centre County at 25k people. Next closest is the hospital, at 2k. Shutting down PSU would literally destroy the lives of the majority of central Pennsylvanians.

It’s absolute folly to think shutting the school down does any good. This is nothing but posturing by the author to get followers. If you are interested in punishment, find another method.
I’m frankly appalled that most of the commenters are so busy bitching about legacies and such, that the simple fact of the matter has once again been missed – young boys were allowed to be abused by an adult male and another group of adult males DID NOTHING ABOUT IT.
As a parent, that part makes me sick. As someone said in another post, Paterno, as a parent and grandparent, should have got off his ass and done MORE.

Maybe shutting down PSU is a little overboard..however, they should decriminalize pooping in public on the campus…and in fact they should make it a tourist attraction C’mon everybody!Poop on Penn State! Where ever you want to go…You just have to go pee? That’s cool too!

Jason – I don’t think anybody doubts this, especially concerning the media specific coverage. The problem is you post about a wide variety of topics and have the potential to offer the same sort of insight, etc. as you do with the media toward these other topics. When you come up short, the hits are still there because the topic is popular, but the longtime readers/commenters complain because of the lack of your opinion, or effort, or detailed analysis..whatever. That’s my take anyway.

25k jobs provided by PSU at main campus, 50k students having to look for new schools, the vast amount of research done at PSU (meterology, agriculture, chemistry, geology, etc.). Not to mention the 17 satellite campuses and all of the jobs associated with that.
Oh and the largest simulated trading floor at any business school in the US.
Yeah, it would hurt a lot…

Ritty – I’m not one of those guys who has a strong, lengthy opinion on EVERY TOPIC UNDER THE SUN. Sorry. Not going to happen.
There will be plenty of times (from my end) where information will be presented, and I won’t have an opinion. Why post it? Because I feel there’s value, maybe many readers hadn’t seen it.

As much as I detest what happened at PSU, the Infante tweets miss the essential point–that the ultimate agency for governance is the Board of Trustees. Once the Board was actually made aware of the malfeasance (and because of that malfeasance wasn’t made aware earlier, as Freeh pointed out), they fired Spanier and Paterno. In short–it did what a Board was supposed to do in an institution where rot and corruption became evident.
It was far, far too late to make a difference for the dozens of victims, but the Board was kept in the dark here–when the lights came on, it took action. I understand Freeh’s rebuke to the Board about creating a culture of accountability, but really-the men who were entrusted by that Board to actually do their job and FOLLOW THE LAW did not do so–how culpable is the Board? I think the fact that the BoT was the only part of PSU that actually acted with swiftness and decisiveness when confronted with the evidence is telling.
I understand the anger and outrage, but shutting down PSU, or the DoE withholding federal aid money (which would do the same thing, essentially), makes the same error that Paterno, Spanier, et al. made–assuming that football is the whole institution. I could understand an argument to shutter football; I might not agree, but I could see the logic. The whole institution? Infante overreacts, and he also doesn’t understand how the DoE works–as long as an institution is properly accredited, they are eligible to receive federal money for financial aid. Will PSU lose accreditation over this? Not likely–though the governance issues are real, the institution can argue that the Board’s action in firing Spanier and Paterno point to an oversight that worked, albeit lately.
It’s an unprecedented scandal, and a damning and damaging report–and there are a lot of people who abused their power in a misguided attempt to protect their own interests at the expense of the victims. And it is reprehensible. But shutting down PSU is an overreaction borne of the raw emotional impact of these revelations. It’s an argument nearly as hysterical as the JoPa defenders make to protect their tarnished hero. We’re better served by drawing out the lessons in administrative accountability and governance that PSU will now provide us.

Jason – I fully support your right to not have a strong opinion on everything you post. In fact, it would be awful if you tried to. But keep in mind when you say that “someone came up with this idea, I endorse it” (which is more or less what you said last post), that it comes across more as your opinion, if not an original one, than you doing your best to relay an idea about which you don’t have any strong feelings.

Issues arise with these educational institutions way more than you realize, most of you don’t know because they aren’t ALL sports related. Recently, the biggest was the backlash of the VT attacks where the DOE got involved with civil suits and the university paid around $40 million total in restitutions. That WILL happen to PSU, but on a much larger scale, and will in fact hurt the university. The first thing to happen will be a major hike in tuition rates, and the faint possibility of a few smaller university departments folding.
The university is obviously fine, but the football team is not. That’s a whole different issue that I don’t know enough about to comment. I assume things will suck balls for them though.
