Phil Mickelson Sued an Internet Service Provider Trying to Get the Name of a Commenter on a Blog Who Keeps Posting Rumors
Phil Mickelson sued an Internet service provider to get the name of a poster on Yahoo!’s Devil Ball golf blog. The commenter, using the names “Fogroller” and “Longitude” has been posting rumors about Phil and his wife, among other things. From Courthouse News Service:
“The postings suggest that plaintiff has an illegitimate child, that his wife has affairs and other similar vexatious statements that are absolutely untrue and, simply put, vicious,” the complaint states.
In a recent post about Mickelson on Devil Ball, Fogroller went on at length about alleged gambling problems for Mickelson.
In his complaint, Mickelson says the San Diego Superior Court authorized him to subpoena Yahoo! for information about “Fogroller” and “Longitude,” and Yahoo! responded with Fogroller’s Internet protocol address, which is registered to a Videotron subscriber.
Now, Mickelson is seeking a court order to get Videotron to turn over the user’s information. This could turn out to be a fairly important case as Mickelson could be setting the precedent for libel on message boards and comment sections. This isn’t the wild west anymore.

at first, i thought it was a ridiculous lawsuit and everything, but then i went back and read through a few of the posts other golf blogs linked and this dude, under a few different names but all saying the same shit, must’ve had like 75% of the total comments on posts with 150+ of them.
it was a little absurd.
i liked when this guy would try and bash phil by listing his accomplishments in golf like they were a bad thing…phil’s got a better resume than anyone other than maybe a dozen or so golfers. the commenter in question is batshit crazy.

The Akron thing was a blind item in the NY Post a while back that casually implied Phil but was not stated. There were more back in the day about him changing clubs for the better money to payoff an illegit kid.

The vast majority of the people who are aware of this rumor are those who are active on internet blogs or sports radio, I would think.
This story, if it gets big, which it should based on the repercussions, will expose the rumor to a whole new audience. Which is hilarious.

If he has a plan to be in office (govt or for the PGA) one day he might be doing this to quell the illegit kid/gambling stuff. One day he’d have to answer it and this process, while making it a bigger issue today, might help way down the line.

If something is not meant to be taken seriously and is just vulgar abuse it is not defamation. If this guy is trying to spread this stuff as true, then it is different. But I haven’t read the stuff.

I’m not a lawyer, and I don’t pretend to have any sort of legal training, but it seems to me that any commenter, when confronted with the accusation of libel could, in light of what you’ve written above, claim that it was satyr or not meant to be taken seriously. And because satyr is protected under the First Amendment, that seems to be a fairly large and easy loophole to utilize in such a circumstance.

Yep, you have to prove damage to your reputation. But we don’t know what Phil is facing. If the PGA or sponsors have even asked him about it and made him explain himself, he could argue that.
I’m not saying it’s a winning case, because defamation is notoriously difficult to prove damages on, but what I was saying is what the guy is doing can definitely be considered libelous if he is trying to spread it as truth* (whether it is damaging is further down the road).

I see what you’re saying now. But wouldn’t it be difficult to impossible for the plaintiff to prove that a comment was not originally meant as satire? Comment sections on blogs now often contain many non sequitur assertions or comments; some are attempts at humor, some are grabs for attention. Without having read the comments, I don’t see how Mickelson’s attorneys could prove what was in the commenter’s mind while writing. It seems like a fool’s errand.

See I don’t see him being active. I’m not thinking BB is expecting many blitzes, so I’d almost rather see Solder at TE, go big on the line, and have a faster back play.

It is a fools errand. He’s enabling the crazy and drawing attention to it, which is even worse.
Exactly. This is like when Erin Andrews announced that there was a video on the internet which showed her naked. It was online for two or three months, but until she announced that it existed and she was going after the perpetrator, very few people had any idea. This seems to be a similar miscalculation by Phil.

Phil’s calculation may be that even though there are a lot of negatives to pursuing this, it’s personally satisfying to him to force this guy into court, face him, make him defend himself and pay the costs.

I doubt that $51 million takes into account taxes, what he pays his caddy, swing coach, trainer, etc. Even then, I’d say he’s still doing well.

2010 he made about $10mm more…no idea if that coincides with his masters win tho. in 2011 callaway had a HORRIBLE year (losses of like $30mm) and it’d be interesting to see if he had some sort of percentage based deal with them too.

be that as it, its just pouring money down the drain. Phil’s team of lawyer’s probably bills out at $500+ an hour and they are not likely to ever collect $500 from the commenter, even if they won the case.
