no. rules of evidence are rules of evidence. civil court just has a lower burden of proof than criminal court does.

Accurate. Fine likely has a case against Tomaselli…but I doubt Tomaselli has any assets. I don’t think Fine has much of a case against Syracuse.

Yes! Between this and the Montana post, it appears actual victims have a nigh-impossible task getting justice. That just ain’t right.

I don’t know if “preponderance of evidence” sways a civil jury. With all the conflicting statements and doctored evidence, what can a jury or judge really hang onto and make a proper judicial decision? How can one maintain the integrity of the process so justice is truly served?
