Bernie Fine Case: Zach Tomaselli, the Third Accuser, Admits to Doctoring Emails From His School and Police
The Syracuse Post-Standard has a story today about Zach Tomaselli, the third accuser who came forward in the Bernie Fine case, and the first accuser who was independent of both Bobby Davis and Mike Lang. You might recall that after the Tomaselli story broke, ESPN ran the story of the audiotape of Bernie Fine’s wife as well that same morning, and by that evening, Syracuse fired Fine.
Today, the Post-Standard states that Tomaselli admitted to doctoring e-mails from both his school district and the police department before presenting them to the paper. This comes on the heels of yesterday’s story where the district attorney, William Fitzpatrick, claims Tomaselli originally told investigators that the assault by Fine occurred at a road game at Connecticut, but changed his story after they discovered there was no game at Connecticut during that time.
Tomaselli’s credibility is shot, especially since there is no corroborating evidence. He can claim he doctored things and lied to reporters, while still telling the truth, but the damage is done. He is the only accuser who would have been within the statute of limitations (plus his allegations of interstate travel raised other potential avenues), but now, it looks like Fine will not be subject to criminal prosecution, and it will come down to where we were when the story first broke, and only a little ahead of what ESPN knew 8 years ago. The tape recording is still damaging, and certainly casts a bad light on Fine and his wife. Bobby Davis and Mike Lang are still pursuing a lawsuit, but no other credible source has come forward now that Tomaselli and the fourth accuser both look to be unreliable.

Calling all lawyers – what legal recourse does Fine have, against either Syracuse or the false accusations? Civil proceedings? Maybe an out-of-court settlement?

Fine will “lawyer up” (to use the parlance of TBL) and a quickie settlement will be reached before a court case is even filed.

Given the fact that the Post Standard (and ESPN) held on to stuff regarding Fine literally 8 years…that leads me to believe that Bernie Fine wants no part of suing them. There’s gotta be more stuff. After listening to that tape, you honestly don’t think there is?

Civil courts are less strict about admissable evidence right? Wouldnt any lawyer just play the wife’s phone call and get the case dismissed?

I’m not exactly sure how some people think they could win a suit against ESPN? They reported allegations…and airing the tapes were perfectly legal. In fact, they could have aired those tapes years ago.

Yes! Between this and the Montana post, it appears actual victims have a nigh-impossible task getting justice. That just ain’t right.
I don’t know if “preponderance of evidence” sways a civil jury. With all the conflicting statements and doctored evidence, what can a jury or judge really hang onto and make a proper judicial decision? How can one maintain the integrity of the process so justice is truly served?

no. rules of evidence are rules of evidence. civil court just has a lower burden of proof than criminal court does.

Accurate. Fine likely has a case against Tomaselli…but I doubt Tomaselli has any assets. I don’t think Fine has much of a case against Syracuse.
