Starlin Castro of the Cubs Accused of Sexual Assault by Chicago Woman
Starlin Castro, the 21-year-old Chicago Cubs shortstop, has been accused of sexual assault by a woman in Chicago. Police would like a word with Castro. According to court documents:
She claims that she was drinking with friends at a River North nightclub on the night of Sept. 29 when she met Castro.
Sources say she and a friend left the bar at 3 a.m. and went to the 21-year-old Castro’s apartment on State Street nearby.
According to the police report, the alleged victim said she blacked out.
She told police she came to, and found the alleged offender – Castro, according to our sources – sexually assaulting her.
It says that when she woke up she screamed and yelled at her alleged attacker, and left the apartment at about 5:30 a.m. getting a ride home from her friend.
It would be 12 hours before the alleged victim would go to a hospital, and police would become involved.
By the time police became involved, Castro was already on a plane to the DR for the offseason. Castro, a 2nd-year player, led the National League in hits (207) and hit .307.

Now I’m not a big city police officer (or a small town one either), but what reason could the Chicago Police possibly have for not having spoken to a person who was accused of sexual assault three and a half months ago. If his name was Ray and he was a street hustler with gold teeth, they would have found him and hauled his ass into the station that night.

First of all, since comments on subjects such as this are known to get way out of hand and fires get stoked pretty quickly around here, let me just say that my concerns are far more with the alleged victim than with the franchise player of my favorite baseball team. That being said…
I’d like to know what took place in the hospital. Did the medical staff draw blood from the alleged victim? If so, did it contain any narcotics? That’s probably the route Castro’s lawyers are looking to take if full denial is their strategy. Narcotics and the words “blacked out” are going to create a whole lot of reasonable doubt for their client.

Extradition is expensive, complicated and time consuming if you want to pursue it.
The incident took place September 29 and she reported in September 30. Looking at the schedule I see the Cubs played their last came on the 28th. So I guess I’ll cut Chicago PD some slack based on that.
Having said that, if he wants to keep being a Cub and collecting those paychecks, he’ll have to return to the states soon.

Who’s the guy saying Castro should talk to the cops? 5th amendment, anyone? Cases like these are often very, very hard to prove. Date rape cases always are (see, e.g., Roethlisberger, Ben; Bryant, Kobe). They’re even harder to prove when the victim has no recollection of events.

Also a good point. If she’s got a witness, visual or auditory, Starlin is in serious trouble.
The court of public opinion is already raining meatballs. It’s impossible to have a discussion about this on Twitter. Immediately goes into an argument of right/wrong or someone is calling one of them a liar. You’ve got the people defending Castro because he’s a Cub (expected). You’ve got the people supporting the victim because there’s a reason why sexual assault victims are so hesitant to come forward. Then, you’ve got the morons. The ones just crushing the victim and calling this all a money grab.

Generally when a person is accused of something, the cops are going to want to talk to him or her. Being interviewed by the cops is not a 5th Amendment violation by itself.
But you are right that cases such as this are so difficult to prove one way or the other. It so very often comes down to “he said, she said”, and without witnesses or corroborating evidence, this likely will go nowhere.

Avoiding the police when you’re accused of a crime is generally viewed as an admission of guilt. Generally and viewed being the key words there. Acquiring an attorney, making sure that attorney is present and going to talk to the police is the best thing Castro can do if he wants to prove innocence.

But you can’t call a possible rape a “poor decision” by Castro, either. There may be poor decisions, it may be a premeditated act… you don’t know, but that just sounds like you are diminishing the seriousness of the accusation.
