Penn State Scandal Roundup Featuring Mike McQueary, Potential Lawsuits, Joe Posnanski & Buzz Bissinger

* Mike McQueary, the receivers’ coach of the Nittany Lions’ who in 2002 saw Jerry Sandusky anally raping a young boy in the shower on the Penn State campus, will not be on the sideline Saturday vs. Nebraska. Apparently, McQueary’s been getting death threats. [Inquirer]
* “A lawyer who is advising some of the young men who said they were sexually abused by Jerry Sandusky, a former assistant football coach at Penn State, said Thursday that the university did not take into account how the firing of the longtime coach Joe Paterno might affect the accusers.” Would the dumb protesting by Penn State students make anyone who Sandusky abused reluctant to come forward? [NYT]
* I don’t believe Randy Galloway is a lawyer, but he wrote a column about the possibility of Joe Paterno going to jail. “Start with the theory that this was a roughly 15-year cover-up, which also qualifies him for enabler status, concerning his friend and longtime assistant coach, Jerry Sandusky, who is now under indictment as a child sexual predator of the lowest denomination.” Those are some bold allegations, Randy. If a blogger wrote that, people would probably talk about said blogger getting slapped with a lawsuit. [Star Telegram]
* And now we return to Joe Posnanski, the SI writer who is writing a book on Joe Paterno. Last night, Posnanski wrote this blog post, scolding everyone for rushing to judgment:
I don’t know what Joe Paterno knew. I don’t know how he handled it. I don’t know if he followed up. I don’t know anything about Paterno’s role in this except for what little was said about that in the horrifying and stomach-turning grand jury findings. People have jumped to many conclusions about Paterno’s role and his negligence, and they might be right. I’ll say it again: They might be right. But they might be wrong, too. … It is still unclear what Paterno did in this case. It will remain unclear for a while.
Based on responses sent my way, it seemed readers were 60-40 agreeing with Posnanski. Buzz Bissinger, as he is wont to do, savaged Posnanski in a series of tweets. (Bissinger also wrote this column.) I’ll leave my dimestore opinions on Posnanski’s post out of this. Sticking to the facts … the Grand Jury report disagrees with portions of Posnanski’s blog post. Let’s go to page seven:
So we do know what Joe Paterno knew. We do know how Paterno handled it. Key phrase: “Joseph V. Paterno testified.” We know for a fact that after Paterno was told his former defensive coordinator was in the shower “fondling or doing something of a sexual nature to a young boy,.” Paterno passed the news on. Reminder: This took place in 2002.
(Aside: It just so happens the Patriot News today has a great piece: Who knew what about Jerry Sandusky? Teaser: “Even though Paterno himself had told the grand jury that McQueary saw “something of a sexual nature,” Paterno said this week that he had stopped the conversation before it got too graphic. Instead, he told McQueary he would need to speak with his superior, Athletic Director Tim Curley, and with Schultz. That meeting did not happen for 10 days.)
Posnanski is right about the rest – we don’t know. We don’t know if Paterno was aware of the 1998 incident (Sandusky, for what it’s worth, “retired” the following year). We don’t know if Paterno ever followed up in 2002 after passing on the news to the AD. Even though it has been documented that Sandusky was always with young boys – at practice, on campus, at bowl games, etc – we don’t know if Joe Paterno saw any of this. Reminder: Paterno and Sandusky worked side-by-side for over 200 days a year for 20+ years. They lived in the same community. But still, maybe Paterno didn’t know.
To be clear, I’m not impugning Joe Posnanski. His track record speaks for itself. But it certainly is noteworthy that one of the best columnists in America is writing a book about Joe Paterno at the very time the biggest scandal in the history of college sports engulfs Penn State and ends the career of a legendary coach.

i think its pretty goddamn clear paterno knew in 98. sandusky was the assistant coach of the year that year, then was fired. you dont fire someone who you know so well, won a big coaching award, and was supposed to be your heir apparent if you dont know anything.
further, sandusky was not approached (at least publicly) about a HC job- anywhere. i am certain that other programs called penis state after sandusky won the award and asked permission to speak with him about a job, which obviously penis state replied with a “too hot to handle’ tag.

What it noteworthy about him writing a book on Paterno in regards to this post?
It may be noteworthy because I don’t remember if Posnasky was among the first reporters to break the story. You’d think being in Happy Valley and having direct interaction with the PSU football program that he might have heard about the coming down of the indictments before everyone else.
Maybe he was just laser-focused on following Paterno and it indicates that Paterno had no further awareness of what was coming down the pipelines. If so, that would exonerate Paterno to a small degree in that he wasn’t going around covering up for Sandusky.
As for the rest, I hate it when people start getting all TV lawyer. “We don’t know all the facts” or “Don’t rush to judgement.” As I said to a friend who started comparing this to the Duke Lacrosse case, we’re talking about multiple victims and eyewitnesses over the course of 13 years. Did they all get together and decide to destroy Jerry Sandusky and PSU for fun and profit?

the dude has been evaluating his life and career with a very indepth perspective, analyzing details and events from multiple different angles so that he can get the true story.
yes, i’m interested to hear what he has to say… but I’m more interested in a well thought out examination after the facts are out, not some half assed, rush to judgement thought based on events that have only seen the one side of examination.
yes, the grand jury testimony is detailed, but everyone should know that’s only the prosecutor’s side of the story. the defense is never in the room when that is taken. Now, what I’m saying is all the questions about the timeline have been one sided and only asked to vet and extract information that will advance the prosecutions case to the filing of charges.
I do think Paterno should no longer be the coach, I do think he probably could have done more based on the current information.
but I don’t think it’s helping anyone, or anything, to rush to judgement when not all the facts have been presented.

Not quite accurate. Sandusky announced his retirement prior to the ’99 season and then coached that year as his last (when he won the award you mentioned). At the time, his retirement was rumored to be due to friction between him/JoePa since Joe wouldn’t name his as the successor. Joe is rumored to have not even attended the retirement party.
Other than that, your facts are spot on.

I am curious. But that line, plus the post yesterday that appeared to discredit his statements because of the book, just makes me think you’re using is to portray a lack of credibility. If that’s your opinion, just come out and say it.
Fredo — I think you underestimate how much access Posnaksi has. Penn State is as closed a program as has ever existed. You cant watch practice. You can’t contact players. You get Paterno once a week for an hour. It is an extremely insular group. A whole hell of a lot of people connected with that program didn’t have a clue this was coming.

TBL, I’m reserving judgment. I do think it is highly likely that Paterno knew something in ’98. He and Sandusky were friends, or at least close acquaintances, for many years. I think that Paterno, with somewhat limited knowledge tried to defuse the situation quietly and this is why he met with Sandusky in ’99 and told him he would never be head coach (though correlation does not equal causation).
I don’t think it is crystal clear that Paterno knew the exact sequence events or the precise details of what was happening. I think he tried to rid a problem from his program. Could he have done more? Absolutely. There is no doubt in my mind that Paterno did not do enough and did not pursue the matter as far as it should have. And for that he is paying the price along with Spannier and Curley and Schultz. But beyond that, I’m not ready to string up anyone for anything, as many others seem to be.

Personally, I don’t think Paterno or PSU went around hiding Sandusky’s crimes. It doesn’t rise to that level of depravity. I think they took a NIMBY attitude with him and turned a blind eye to his potential for further abuses. If that is the case, it would explain why they were blindsided by the charges and the speed with which everything came tumbling down.
It is surprising to me though that the authorities were able to mount their investigation with no one leaking something to PSU. College towns tend to have plenty of alums who will try to protect the institution — see: attorney calling Jim Tressel about the tatts investigation at OSU.

becuase the prosecutor is only looking for facts that would indict on charges and move to trial.
ever hear the term “you can indict a ham sandwich”?
there’s no burden of proof in this stage, just a presentation of evidence that has been collected by the prosecution.
statements given in a grand jury testimony haven’t been vetted or challenged by a defense attorney.
and while this is still sworn testimony, it’s still only one side of events in how this happened.
guy a told guy b what happened. guy b called up guy c and gave his version of events, guy c spoke to guy a.
there’s no thorough examination of the chain of events that would create the full story. what is presented in the grand jury testimony is just enough information to convince 9 or 10 of 16 people there’s enough information to formally indict on charges.
i do suggest people accept grand jury duty, it’s fascinating and eye opening on the legal process in america.

Really? When someone is held in such high esteem and they’ve done so much good we tend to believe they would never do this stuff. We then here about what happened and it shocks people into a state of rage and anger. When you are presumed to be squeaky clean and it comes out that not only are you not that man, but you let something like this go unchecked for more than a decade, the reaction is in line with what I would expect it to be every time.

No one even tried to find out who the boy was in 2002 after the incident. That’s inhuman and telling someone else does not exonerate you from your moral duties as a person. This basically is the crux of Posnanki’s argument. It’s obviously a shit storm, nobody’s denying that. But there’s a lot we don’t know and prematurely going batshit crazy isn’t helping anyone.
What I find amusing in all this is that people read that grand jury report and assume that every detail is included there, or that everything in the report is spelled out in full.
This is a series of incidents and interactions that took place over more than 15 years! You can not possibly boil every nuance, motive, and conversation down and expect to capture that all in a 23-page document.
There is a LOT we don’t know, can’t know, and probably won’t know for months until reporters or a trial bring it to light. It may well make everyone involved look worse than they do right now, and if so to hell with ‘em. But it might also make a lot of people look better than they do now.

Exactly. A lot of people are taking pieces of from the report and assuming certain things were said or done during the time period that isn’t listed in the report at all.
For example, the investigation by the police in 1999. Many assume everyone at Penn State heard about the investigation, but in reality, Sandusky didn’t have to tell anyone he was being investigated since he was never charged. Second Mile was informed but there is no information that anyone from Penn State was told.

You can still buy liquor in bars after 12. Some counties are worse than others. My father and stepmother have a house in Tyler, Smith County, which is the heart of East Texas. The county is dry (no liquor stores, no beer in grocery stores or gas stations), but you can still buy booze in restaurants and the few bars they have. But you have to have a ‘membership’ with the county to do so. The membership costs about $10 a year I think. Though it’s probably gone up since then. When you cross over the county line, the neighboring counties are mostly wet and so they have huge liquor warehouse stores to serve people driving over from Smith County.
Gotta love Blue Laws.

Paterno may have not done enough, but if you want to find people who actively sought to ignore the situation, look no further than the administration to which Paterno reports. Seeking Paterno’s blood simply because he is the “face of the university” is not only unfair it’s illogical and misplaced.

likely going with a mini subway tile mosaic in the bathtub surround, and a nice black and white honeycomb mosaic floor tile.
i wouldn’t have thought about doing it until i learned of the tile adhesive that’s used in place of grout on the walls and floor. sheets you cut to fit, peel off the plastic and lay on the tile. let it adhere and then grout betweent he tiles and done.

Right now, their silence is deafening. People are paying attention to Penn St. right now because that’s where most of the documented incidents took place, but the grand jury report states that Sandusky would meet kids at these events and then invite them to his house, school events, etc from there. Did any of these kids, once they managed to sufficiently ignore Sandusky, ever say anything to those at 2nd Mile? I find it difficult to believe that NOTHING was reported to an administrator, peer, staff member, etc. As soon as the focus dims on Penn State, 2nd Mile is going to have a the microscope hover over them.

Fair point jekyll, but the exchange over that stemmed from the larger point of whether to take as fact the grand jury report. Putting Paterno aside for a moment, a grand jury indictment by definition only contains one side of a story as presented through questioning by a prosecutor. Whether the facts then hold up in court under cross examination and after investigation by a defense team is TBD.

moved into my house on the hottest day of the year, wife and i take showers at night, sewer backs up into the basement a bit. nothing filthy, but stinks. plumbers come out, the PVC clean out is cracked and filled with dirt and roots. $3500 bucks on day 3 of living there.
just had drainage work and regrading done, about $3000. roof in about 12-18 months, $7700.
worth it though since we paid far below the actual value of the home.

Well, you are right, but only to a certain extent. I think it’s fair to say that Sandusky’s atty (if we a good one) would have been able to cast confusion on Paterno’s testimony.

And I agree with you. And this has been the point of several of us on here who have wondered aloud at why the vitriol is being directed at Paterno rather than Curley or Schultz who are currently under indictment.

We got the same situation, but it was as-is, and didn’t get the insurance. We knew most of the issues, though the subfloor surprised me. The sellers were just assholes who refused to realize that their dead father was a fucking moron who didn’t know how to fix half the shit he tried to do with the house, and we had to decide if it was worth the effort involved to get the home.
I don’t regret it, but it’s a lot of work for a first home for both of us, and we are learning a lot of how-to (which is nice).

Thought his very personal take on the matter was really good. I disagree with him that Paterno has been made a scapegoat by the PSU BOT. This all happened really quickly, the few days they took before they made a decision to fire him was to be expected, I think. The rest of it was great, though.

Long time/first time.
20 year practicing attorney (although not criminal practice). For those in the “let’s wait and see camp”, one other thing to consider that I have not seen raised here. State Attorney General and State Police Chief who are privy to the actual grand jury testimony had absolutely no hesitation in absolutely crushing JoePa for his “moral failure” in not reporting to police.
Folks like that are generally cautious by nature, particularly with a pending investigation. To say what they said with such conviction would tend to make one think that perhaps the evidence is quite strong.

there was no way to tell about the sewer clean out, it was the second one and half way between the house and street, likely got worse after the inspector checked the water flow.
roof, we knew about and got money back on
drainage, also knew about, it was partial cosmetic.
the house was priced so low that we were the first to offer the day it went on the market, and between the time our offer was accepted and we closed we had found out there were several other offers significantly higher than ours that would have been accepted if our deal fell through.
we got it for list and it was valued at $25k more than we paid.

What vitriol, though? Is there someone who’s opinion you valued before this who has demonized Paterno? Everyone worth reading basically says the same thing, what we know about his actions are incredibly and really beyond disappointing and he deserved to be fired.

we actually got them to replace the roof, which was apparently damaged (was a cedar shake shingles). There was a lot wrong but we had to act because there aren’t a lot of places within the city limits where you can get some land.

we also loved the lanscaping around the house we bought, until closer inspection realized it was in lousy condition. but that’s grunt work my dad and father in law are happy to do for beer.
ceiling, upon closer inspection when paiting needs repair in the family room.
nice thing is that everything the inspector told us we could expect has occured so no real surprises outside the sewer thing.

we lucked out and got 1.25 acres in a place where most homes half less than half that.
our roof is cedar shake and the shingles are in bad shape, but that’s actually keeping us from having to replace right away as the cedar shake expands with moisture, preventing leaks.

Posnanski and any defender of him is out of their element on this. They are sticking up for a friend. It’s hard to believe Paterno sat on news that someone in the program was raping kids.
