No. There are a number of states with reporting requirements…Paterno fulfilled any and all legal obligations he had when he reported the incident to the AD. He did the bare minimum required by law. Not absolving him of blame whatsoever…but legally, he’s already been cleared by a grand jury.

Here’s what I don’t get: guy shows up at Paterno’s door and says “I just saw Coach Sandusky raping a 10-year old boy.” He calls the AD and the VP. WHY don’t they call the police then and there? Yes, it’s horrific it’s happened at their school, but reporting it quickly gets them to say that they’re victims of Sandusky’s behavior. That he duped them and used them to prey on children. There’s a minor hit but PSU comes out of it okay and there’s no stigma against the school or the program.
How is that worse than covering it up, lying on the stand and going through what they’re about to go through now??

Again, what I think is even worse than the whole argument here, is that this exact scenario WAS ACTUALLY IN FRONT OF THE CENTRE DA 4 YEARS PRIOR. He elected not to pursue it despite Sandusky’s entire “I’m sorry – it won’t happen again” deal which HAPPENED WITH A POLICE PRESENCE.

Why not call the cops in that exact moment he knew something inappropriate was happening. Or try and stop it. I have trouble understanding how his first move is to tell the head coach.

Isn’t this inevitable? I mean what deserves the death penalty is this doesn’t?
Bare with me here — did they violate any NCAA rules? Clearly this is worse than SMU, OSU, USC, Miami ect — but those were NCAA rules. Was Baylor put on NCAA violations when the teammate killed the other? I am actually asking that, I do not know the answer.

Does the NCAA even have the power to give the death penalty for something like this? I guess they could call it “lack of institutional control”, but wouldn’t the criminal charges supercede any punishment the NCAA could administer?
Lack of institutional control only refers to an institution that fails at every level to meet NCAA rules. As has been pointed out, as disgusting both the alleged actions of Sandusky and the blind eye given by the administration, they are not NCAA violations.

Although, I can’t imagine the NCAA ever felt there was a need to include a rule stating that it’s wrong for an assistant coach to molest children in campus buildings and that it’s also wrong for that school’s administration to look the other way.
But even though it’s not a written violation, there are certain things that a school’s administration has to know, must know, are wrong. And turning a blind eye to an assistant coach forcing himself on young boys is certainly one of those things. And while I doubt we are talking about a Death Penalty scenario, I do think the NCAA will be involved with this somehow.

I looked it up and they were. It seems funny to me the term of “lack of institutional control” — like you are out of control if your players take a non working job, a envelope with cash, trade tats for memoribila, use an agent for whatever reason but somehow “Former legendary coach with strong ties to the program rapes 10 year old boys while high powered school officals turn a blind eye” doesn’t fall into that.

Any PSU fans that are defending Paterno or talking about “finding all the facts” in reference to Sandusky should kindly see themselves out. It’s like irish blindly defending Miami when all those allegations came out, only 100x worse because 10 year old kids were getting fucking RAPED IN SHOWERS AT THE PSU FACILITIES

Col. Parker, see Dr. Tom’s paragraph. The sanctions sound as though they were related to improper payments. I don’t believe there have been any allegations yet of Penn State involving payments one way or the other. It doesn’t sound like players were involved at all. So this is a different situation from Baylor’s.

if you can’t trust the icon of the program to turn in a diddling coordinator (or even take his keys for the athletic facilities away, for that matter), why do they get the benefit of the doubt when it comes to NCAA integrity?

I think as in with every other decision the NCAA makes, they will consider their pocket book first before coming down with sanctions. But I think something needs to happen. If USC gets a two year post season ban and a loss of scholarships for 3 additional years beyond that for ruining “amateurism”, they better come down on a program for this…it is pretty clear a blind eye was turned for a long time and the people in charge of the program were complicit in overlooking these crimes.

Bat (Bait?) signal? I was familiar with this case back then and a case could not be put together. This comes on the heels of a very tense relationship with the DA’s office post-Bobby Ingram where views of the program, and Paterno, significantly changed. I can say with a high degree of first hand conversation, Penn State was not, nor would not, be protected by that particular DA.
Like I said earlier, the Sandusky thing was not an unknown in the area. How you seem to have missed it is beyond me.

Baylor’s NCAA violations may have come to light because of the Dennehy murder…but the hammer came down because of blatant pay-to-play schemes directly oversaw by Dave Bliss. Not to mention, Bliss was personally footing the bill for 2 of the players.
The Baylor and Penn State situations are not analogous….yet. I suspect that the Penn State program is going to be put under the NCAA microscope for sure…but if the only facts that come to light are what we already know, there will absolutely be no NCAA penalty.

Sandusky’s biggest mistake was that he isn’t apart of the SEC. ESPN would just sweep this under the rug. That or rank him slightly above Michael Jackson in the Child Fucker BCS Standings. Causing all the more uproar since they tend to overrate everything SEC. Which of course we all know is bullshit since Michael Jackson has proven time and time again to have the best Defense in the world. Michael Jackson was basically an SEC team.

Been busy, but have skimmed the posts today.
SG, yes it was known around State College, especially those around 2nd Mile, which is why much fault lies with those around him, and especially Paterno.
Roeth, I know that a case was tried to be put together because I talked about it with him after catching rumors for a prominent friend who works with 2nd Mile. If a successful prosecution could have been put together based on that first reported incident, I have the utmost confidence that it would have been. Part of that is due to Bobby Engram earning the “Bobby Ingrate” nickname after Paterno intervened on his behalf and then not so much as a thank you was extended. That DA was as beholden to the football team as you are to the Cleveland Browns. He was most definitely not a politician. On another front, I know that he was a staunch Catholic who became non-practicing due to way the church handled many of their own issues. When you combine the two, I wholeheartedly think that if a successful prosecution could be put together, based on that initial claim, one would have been.

Someone mentioned the “death penalty” for PSU athletics. While I understand the disgust at Sundusky’s actions and the lack of follow up or intentional cover up, it’s not related to breaking NCAA rules. It’s just against the law. They should all be put in jail and they should throw away the key. Penn State just took over for the Catholic Church because that institution is going to get sued for the next 20 years, and it will be paying out millions and millions of dollars of damages. Might be worse than the death penalty.
