Judge Declares Mistrial In Roger Clemens Case
The Roger Clemens trial is over, for now. According to ABC News Roger Clemens will get a new jury, as the judge has declared a mistrial because the current jury has been contaminated with false court-un-approved facts. Via ABC News:
The judge halted proceedings this morning over complaints from the defense about the prosecutors use of information the judge had banned – and then the judge quickly accepted their concerns and declared a mistrial.
The defense had complained that prosecutors had not followed a pretrial ruling to limit information about conversations fellow ballplayer Andy Pettitte had with his wife about the use of human growth hormone.
The search for 12 new redneck Hall of Fame-caliber pitchers with ridiculously spiked hair will begin soon.
The New York Daily News has more info on the Pettitte conversations:
In the 2008 clip, Rep. Elijah Cummings (D-Md.) praised pitcher Andy Pettitte and discussed an affidavit Pettitte’s wife Laura gave Congress in which she said her husband told her Clemens had acknowledged using growth hormone.
Walton previously ruled Laura Pettitte’s testimony was double hearsay and could not be brought up except on rebuttal. He also said Cummings’ praise for Pettitte, a key witness in the case, would unfairly prejudice jurors.

as i said in the last thread, inept prosecution isn’t exclusive to Florida.
how fucking hard is it to follow the rules?

Good now fix the debt ceiling assholes
July 14th, 2011 at 12:29 PM
If only Trey was still here, or if Jay V dropped by, to say why they couldn’t talk about Clemens conversations with Pettitte.
July 14th, 2011 at 12:29 PM
there will be a hearing to determine if another trial would be double jeopardy
July 14th, 2011 at 12:30 PM

don’t be silly. eventually the debt ceiling mess will destroy both republicans and democrats and we will be stuck with a government run by media pundits and talking heads.
July 14th, 2011 at 12:35 PM
lol.
July 14th, 2011 at 12:36 PM
I just dont like the idea of all of us having to pay for their wreckless spending. The United States goverment is a huge clusterfuck
July 14th, 2011 at 12:36 PM
I was up at 4 am this morning, watching CBS Up To The Minute News. The woman who introduced Walsh (the Republican Representative from I’m-not-sure-where) saying Obama was lying, played two seconds of the clip then talked about for three minutes how he’s famous for bashing Obama and will probably lose his seat soon anyway. I know it’s 4am, but come on.

Also it would be nice if politicians and pundits would calm down and actually tell the truth about the debt ceiling, but that doesn’t get your name in the paper or increase ratings, so…
July 14th, 2011 at 12:39 PM
like this wilhelm?
July 14th, 2011 at 12:39 PM
The prosecution wanted to include testimony by Andy’s wife, but the judge wouldn’t allow it because she hadn’t spoken with Clemens directly. The testimony was that Andy told his wife about it, not anything like Clemens told Andy’s wife he was using or anything, so it’s all hearsay. The prosecution showed a video that include mention of Andy telling his wife that Clemens was using, and the defense had a hissy fit.

We’re going to have one in Lexington in the parking lot of your station.

July 14th, 2011 at 12:47 PM
I do think it will be a problem.. close some but not enough to get the $17.5 million. The only way it works is if Boras can’t get any of the $17 vesting option, and so they let him close just enough to retain value, and he gets a good deal on the open market. I hope it works out, but unless Milwaukee makes KRod convinced they are preserving his value and he will get a big contract worth way more than his option, it could go badly.
July 14th, 2011 at 12:47 PM
Debt ceiling? What ceiling? Just hop in this and pedal faster.

the best way to distract the media from the truth is lie, b/c then the media identifies the lie, talks about the lie, gets side tracked again by another lie or spin, and completely forgets the truth they should have debunked the lie with in the first place.
see the obama birth certificate issue, health care debate, and recent republican claims about the debt ceiling debate.
instead of presenting the facts about the debt ceiling issue and our deficit, they are talking about the drama.
although, if they talk about the facts everyone would see how corrupt and rediculous the GOP is and then what would there be to talk about when these guys are not re-elected b/c of this?
July 14th, 2011 at 12:52 PM
Yup.
I mistook you for a middle class white guy. My apologies, extremely poor black guy.
July 14th, 2011 at 12:53 PM
Very well. hindsight is 20/20 but I think McClane would have done something sooner (sell or try to improve the team) had those two years been the beginning of the downfall for the Astros. He always thought his team were contenders and I’d like to think that maybe he would have seen the writing on the wall….maybe im just talking out of my ass!
July 14th, 2011 at 12:53 PM
Hahahahaha. I’m white.
July 14th, 2011 at 12:54 PM
That was supposed to be the joke… as in they won’t make the playoffs. The more I think about it, I guess KRod really will have to be a good soldier just to keep his value up, whether he is happy with his role or not. To be determined I guess. I’m just not sure closer-by-committee works… You are right though in saying that if they make the playoffs = success.
July 14th, 2011 at 12:54 PM

WWOS… the clause in Frankie’s contract is that he simply has to close out 21 more games, he does NOT have to save 21 more games. So theoretically, the Brewers could just pitch him in the last inning of games they’re losing, or non-save situation games, and he could still get his option vested.

I have it. I like it. It has a lot to choose form and an easy format to find stuff based on channels. The difference is it is not streaming like most cable on demands. You actual download what you want to watch to your DVR. That can be bad if you want to watch something right away but also good because you can fast forward stuff that you couldn’t on cable on demand.
July 14th, 2011 at 1:06 PM
I have DirecTV, and DirecTV Cinema is not the reason. It is OK…but when NFL rolls around, you will know why you chose wisely with DirecTV.
July 14th, 2011 at 1:06 PM
Re: Debt ceiling…
Republicans need to quit being stubborn assholes and say that–you know, MAYBE–tax loopholes and exemptions for the ultra rich are kinda a bad thing and revoke them.
And Democrats need to sack the fuck up and admit that we need to push back the Social Security age to 67 or 68.

how long does it take to download, 1 hour show or 2 hour movie?
i’m assuming you’re getting much better quality and not losing anything due to compression like you would ondemand or streaming.
July 14th, 2011 at 1:12 PM
yeah, it’s called compromise…the problem is since the president is the one offering a true compromise, the republicans see it as a disastrous loss to their attempts at getting him out of office so they won’t capitulate at this point.
but they greatly misplayed their hand, if this does down and no resolution is provided b/c they said “no” to a compromise that would have gotten it done they will be the villains.
they have to save face on this now and compromise to avoid economic disaster.
July 14th, 2011 at 1:13 PM
It all depends on your internet connection.
You can queue up as many shows/movies as you want…and then the next day they are all on your playlist. If you want to watch something right away, the menu icon will turn green to let you know you can start watching and the download will always be ahead of you.
July 14th, 2011 at 1:13 PM
I think it all depends on your internet speed because that is where its coming from. A one hour HD show took about 90 mins for me. I did not really mind. Once a week I will just browse the cinema and download a bunch of stuff. Watched the entire season of game of thrones this way. And yes the quality seems much better than on demand streaming.
July 14th, 2011 at 1:15 PM
awesome, thanks for the info Babar and YYSA.

July 14th, 2011 at 1:16 PM
Not long, 5-10 minutes.
Also, yes.
July 14th, 2011 at 1:17 PM
I think so. It also depends on what your premiums are. That will greatly increase your catalog. I just dropped Netflix and picked up an extra movie channel yesterday as a matter of fact.

July 14th, 2011 at 1:30 PM
Revenue to GDP is the lowest it’s been since the 30′s. Maybe getting some jobs created, ending the Bush tax cuts would help that category out. A little 3 1/2% is going to crush the economy and all of the $250,000+ earners so much.
July 14th, 2011 at 1:31 PM

I wasn’t aware that someone who makes $400,000 was a job creator? Or someone who made $19 million last year and is about to cut 10,000 jobs was a “job creator” (John Chambers, CEO of Cisco)…the right wing arguments are jokes.
July 14th, 2011 at 1:36 PM
You’ll be waiting until Sept 2012 at the earliest.
July 14th, 2011 at 1:36 PM
look. you just cant keep spending money the way we have been and then ask people to pay more taxes. its foolish
July 14th, 2011 at 1:37 PM
yeah because these companies are doing just a fantastic job at job creation now .
July 14th, 2011 at 1:37 PM
they are jokes, but instead of presenting the facts that debunk their jokes (the bush tax cuts making up an increasingly large portion of the current defecit), the media repeats the false claims until all that’s all you hear.
July 14th, 2011 at 1:38 PM

July 14th, 2011 at 1:39 PM
right, which is why you take a balanced approach to cut spending and increase revenue at the same time.
it’s common sense. if you’re “broke” you don’t just cut spending to reduce debt. You cut spending and you find away to get more money to reduce the debt.
July 14th, 2011 at 1:39 PM
This.

Maybe the 47% of the population that pays no federal income tax at all would be willing to chip in?
July 14th, 2011 at 1:41 PM
That being said, there isn’t one Republican I’d vote for right now outside of Gary Johnson or Paul. They have about a 0.002% chance of getting the nomination, however.
July 14th, 2011 at 1:43 PM
and get rid of the illegal aliens that leech off the system without paying into anything
July 14th, 2011 at 1:43 PM
I don’t know nearly as much on business as some here, but why would a business hire someone, give that person insurance, add to their payroll tax, if they already have someone doing that job right now? It doesn’t seem to make sense that a business would take on more of a financial burden if they can already get the job done with the staff they have.
July 14th, 2011 at 1:44 PM
From what AM radio show did you find this?
July 14th, 2011 at 1:45 PM
I think the illegal aliens thing is completely overblown. I believe the states have the right to enforce immigration laws, but let’s stop acting like every Mexican or Ecuadorian is part of MS13 or a drug cartel.
July 14th, 2011 at 1:46 PM
so, GE is now considered illegal aliens?
July 14th, 2011 at 1:46 PM
This is the new GOP taking point. Because companies haven’t been cutting jobs and outsourcing even with rates at an all-time low and loopholes at an all-time high.
July 14th, 2011 at 1:47 PM
So you’d be willing to raise taxes and get rid of tax deductions for almost half of the country? Wow you’re an idiot. Shared sacrifice…taxes always went up in wartime in this country, why didn’t they (instead of being cut) during Iraq/Afghanistan? Biggest drag on the deficit is Bush’s tax cuts. And oh yeah, your saint Reagan raised taxes 11 times while in office.
July 14th, 2011 at 1:47 PM
i think we should grant amnesty, and tax them. it’s the same as weed. we spend x amount of dollars fighting it, but we could generate even more revenue by taxing it.
July 14th, 2011 at 1:48 PM
There should just be a flat tax and be done with all this nonsense. Problem solved in 3.2 seconds.

Don’t underestimate neocon’s and pepole like MikeNYC, they tried to elect Sarah Palin as Vice President 3 short years ago…Maybe they can get Bachmann and Palin on a “Super Ticket”
July 14th, 2011 at 1:51 PM
What’s the maximum amount of money you can make a year to not pay taxes? Isn’t it something around $10,000? I’m ok with someone making less than $10K not paying taxes.
July 14th, 2011 at 1:51 PM
wow, that would be great business for SNL.
i’d love to see that, actually. those two would put shaq to shame for being some quotable.
July 14th, 2011 at 1:51 PM
“Shared sacrifice” —
Top 10% earners pay 71% of federal income taxes.
47% of earners pay zero.
Is it any wonder nobody takes your party seriously when it comes to economics?
July 14th, 2011 at 1:53 PM
considering that 47% would generate far less in tax revenue than the top 1% with only a marginal increase in taxes or the closure of tax loopholes.
if the right wing had their way the american worker would have worse working conditions a lower pay than the child labor force who made my nike running shoes.
July 14th, 2011 at 1:53 PM
Because of deductions, they don’t make enough or credits. But keep on trucking that out. All the right wants is to cut, cut, cut and let the rich keep fucking the country.
July 14th, 2011 at 1:56 PM
If 100 people went out to dinner and ordered the same thing and the tab was $5,000, this is how the party of “shared sacrifice” would “fairly” divvy up the bill:
10 richest people pay $3550.
43 next richest people pay $1450.
47 poorest people eat for free.
Shared sacrifice.
July 14th, 2011 at 1:57 PM
do you have a breakdown of what bracket(s) these 47% resides? Also, if so, do you have a breakdown on how much potential income we’re losing from not collecting from this 47%?
July 14th, 2011 at 1:58 PM

Just like real life!!! Because the bottom 47% eat the same meals as the top 10%…Please.Fucking.Stop.
July 14th, 2011 at 1:59 PM
Oh, and after dinner was over, they’d bitch and moan that those 10 people didn’t pay enough and were ripping off the people who paid zero, and would demand those 10 paid even more next time, all while eating the free meal.
Shared sacrifice.
July 14th, 2011 at 2:00 PM
maybe congress and the senate can start with salary freezes in both houses, pension cuts and having to pay for their own benefits. That seems to be the new trend these days.
July 14th, 2011 at 2:00 PM
so, going out to dinner is a shared sacrifice equivalent to all living in the same country? Why would I go out to eat with someone who I know couldn’t pay?

Shared sacrifice.
Just kill the bottom 47%, problem solved

the two party system never ceases to fuck us over

Ty Webb, your analytical and economic skills are second to none.
Bingo.
July 14th, 2011 at 2:02 PM
maybe congress and the senate can start with salary freezes in both houses, pension cuts and having to pay for their own benefits. That seems to be the new trend these days.
how could they create jobs if they have to pat for their own insurance!?!?!?!
July 14th, 2011 at 2:02 PM
now i’m curious.
what’s your salary, Mike NYC? i’m giving you the benefit of the doubt and am assuming you’re in the top 1% that would be taxed more, otherwise i’m not sure there this economic ignorance comes from. if you’re not in the top 1% i’d be interested to know your main reasons for defending a policy that has created the largest divid between the classes in decades.

Mike obviously wants the country to become like Argentina in the 80′s or France in the 1780s where the rich piss on the poor and tell them to keep sacrifing.
What more do you want the majority of the population to do? There’s no jobs because they’re all in India or China. You cut the safety ne, so they have to work for $7.25/hr at WalMart with no health insurance and when they get sick and go to emergency room, causing an endless debt loop. But tax cuts for the rich! They’ll create more jobs…in India and China.

you saw my work history?

Ty Webb, your analytical and economic skills are second to none.
yes, your dinner analogy was unparalleled

Just out of curiosity, what percentage of overall income do the top 10 percent earn? I have no idea, but it might shed a little light on your statistic.
July 14th, 2011 at 2:13 PM
It’s not bingo. That 47% encompasses a significant portion of the consumer class in this country. The more accurate depiction of your scenario would have the restaraunt owner giving out 50% off coupons to the people in the first group, while placing the burden to pay the bill on the middle group. Of course there are saps in that middle group who speak out vociferously on the “unfairness” of the top group having to pay the most, because how else is everyone else supposed to receive the scraps from the top guy’s plate.

If they are too poor to pay any taxes at all, how much consuming can they be doing?
July 14th, 2011 at 2:23 PM
Another point is that just because they don’t pax federal taxes on their 1040s, doesn’t mean they still pay payroll, medicare, unemployment, state, local taxes out of their paychecks. But keep parroting the 47% figure, because it’s full of shit.
July 14th, 2011 at 2:27 PM
47% of the population paid no federal income tax in 2009. True or false?
You’re not very bright, are you?
July 14th, 2011 at 2:28 PM
True, but they paid taxes of some sort , and payroll taxes are a federal tax. Obviously you can’t read.
July 14th, 2011 at 2:30 PM
Taxes for some, miniature American flags for others!
July 14th, 2011 at 2:37 PM
Still waiting for why a flat tax wouldn’t work. The IRS can be shrunk, and then tasked with closing up loopholes and auditing. Win, win.
To Darrell’s point about the 47% being consumers, they also get goods and services provided to them for free.
July 14th, 2011 at 2:44 PM
Sorry not Darrell, but Ty. They do eat the same meals, because the 47% partake equally (if not more so) in the things my tax dollars pay for.
July 14th, 2011 at 2:46 PM
because you’re taxing the poor a disproportionate amount than the rich in real world terms. assume a 15% flat tax…a $10k/yr household income would be crushed by that while a $100k/yr household would pay less than they are now.
