North Carolina Football Facing Major Violations, But Butch Davis Probably Stays.
North Carolina’s football program received notice of nine potential major violations yesterday. Individually, the charges weren’t revelations, but the collective load adds some new heft to the scandal. The Tar Heels more extensive charges than USC or Ohio State, but the public outcry is mitigated. No one cares about North Carolina football.
Here are the basic allegations.
Employing a Runner: John Blake was a runner who steered players toward now-deceased agent Gary Wichard. He received $31,000 in outside income he didn’t report. He also did not disclose a $45,000 payment from 2007.
Improper Benefits: Multiple players accepted around $27,000 in improper benefits during 2009 and 2010 from agents, former players, financial advisers and “Willie.”
Academic Issues: A tutor committed academic fraud, writing parts of and doing research for papers. Jennifer Wiley provided 142 hours of free tutoring, a $150 airline ticket and paid $1,789 in parking fines. She also tried to evade the investigation.
Obstruction: A redacted player, likely Marvin Austin, misled investigators about who paid for trips he took in 2009 and 2010.
Failure to Monitor: The university didn’t monitor the players (social networking) or the use of the facilities adequately. They should have recognized evidence of violations and investigated. Crucially, this was “failure to monitor,” a lesser charge than “lack of institutional control.”
Before getting into the practical ramifications, I’m through crucifying players for accepting benefits deemed a job perk for those employed by an athletic department in other capacities. How many flights on a private jet did the North Carolina AD take during those two years? How many frolics? How many lavish banquets? How many free rounds of golf? How many administrators and coaches have their car leases taken care of? Is anyone paying to watch them do their jobs?
It’s fine that the people who look like me and come from a similar socioeconomic background to me profit blatantly. Yet, I’m supposed to be outraged by a star football or basketball player, likely poor and black, taking a trip to Miami or California or meeting with a prospective agent who is going to handle his obvious financial future? A player accepting $3,800 worth of goods and services is the system’s bane when Butch Davis, a public employee, makes more than $2 million per year? That’s ludicrous. Rant over.
What happens to North Carolina? We still have months of deliberations and hearings before actual sanctions. The violations are serious in their own right and startling when taken collectively. Agents, academic fraud and improper benefits are each major areas of concern for the NCAA. Then there’s the failure to monitor all three.
Undoubtedly, the Tar Heels will vacate wins for fielding ineligible players from 2008 to 2010. This will be meaningful, if Butch Davis ever looks at a record book. UNC will try to dump as much of the blame (with plausible validity) on Blake and Wiley. They can also claim to have been cooperative and vigilant rooting out the problems since they emerged. They should face scholarship reductions and a postseason ban as well, potentially up to USC level.
What happens to Butch Davis? He was lucky. The NCAA just charged his program with major violations, but he’s not directly listed or involved with any of them. Broadly, he’s the guy in charge. He can make an empty claim that he takes full responsibility, but there’s no failure specifically pinned on him, especially if the NCAA considers Blake to have acted surreptitiously. UNC did not fire Davis when the allegations initially emerged. Firing him doesn’t help their NCAA case. He probably remains unless public outcry demands a scapegoat.
Has the coverage been fair? Fans of Ohio State, USC and Auburn have to be pissed. Their schools received far more scrutiny for their real or potential violations that were less extensive and arguably less serious. Some of this is the nature of UNC’s scandal. It was multiple independent issues, rather than something with a singular focal point, such as Pryor, Newton or Reggie Bush. Most of it is that few people care. It’s a non-traditional football school. They haven’t won more than eight games since Mack Brown was there in 1997. Greatness being humanized is a sexy cover story. Mediocrity? Not so much.

Ty, like to hear your thoughts on the OSU penalties if the violations end up remaining confined to just the Tat-5 and Tressel. Meaning: the SI piece becomes marginalized (many starting to think nothing will come of it, and Pryor is not talking to NCAA at this point…and it looks like the car deals are in the clear).
Vacating last years wins, minor scholly reduction, and 1 year bowl ban? Failure to monitor and nothing else?

This kind of thing is sort of a running theme in the ACC. Miami, FSU, Virginia, UNC, Georgia Tech, even Virginia Tech – they’re record of putting players in the league just doesn’t match up with the lack of national title contenders since the pillaging of the Big East

I think use of the word sexy needs to be reeled in. What is left out, and what I suspect the NCAA will continue to look into (via Butch Davis’s phone and bank records), is that the tutor (Wiley) who provided the improper benefits and paid for the parking tickets, WAS EMPLOYED BY BUTCH DAVIS after the school relieved her of her duties. So she was providing benefits with money received from her employment with Davis. Hmmmm

When the NCAA vacates the wins does it also ask for the bowl money back? Also, if UNC wins games with these players and the teams they beat end up going to a lesser bowl or no bowl at all then they should get some of that missed bowl money. But based on the articles from January, those schools would have lost more money than the bowl visit was worth anyway.

The upper level administrators do get perks, but that is no different from any other institution, including academia. I assure you like in any venture in this capitalist society of ours the people at the top get the best perks and the biggest salary. Do you want to talk about the benefits the football players get as DI athletes? The training table meals, the free gear, the advanced academic support, the trips, the chance to showcase their skills, the comp admissions to games, the free room and board.
Also, if a kid needed to take a flight somewhere for an important reason, there is a fund setup that will pay for it through the athletic department.
However, keep painting with your broad brush.

Another difference between their case and OSU and USC is that they reported the violations themselves AND the only people you can say that were not forthright with investigators is Austin (player who accounts for more than half of that 27k) the tutor (again, was abanging one of the players) and Blake (shady mcshady that was fired). There was no attempt at a coverup. UNC suspended 14 players this past season when they learned of the allegations. They didn’t try to employ a loophole or flat out show disregard for the rules.

He’s railing against a given human tenant in our society right now. As I mentioned, people at the top are bilking their systems for all they can get. You look at high profile ADs, they get cars and country club memberships as part of their contracts. They get to travel to cool places and rub elbows with other big shots. It’s the way of the world right now. But do you think the 3rd level sports info director at the department is driving around in an unleased porsche? Please. For someone who grew up down the road from Isiah Thomas, duffy sure doesn;t have a grip on how the upper tier operates.
And what is his solution? Pay the players with money the athletics’ departments don’t have? I am fully behind letting players collect something from the use of their images, but overall that will be a small bit in contribution to the cost of attendance they are already getting.

Bilking is probably taking it a bit far. These people worked very hard for many years to reach these positions, positions that inherently come with certain advantages.
My issue is comparing the earnings of a middle to late aged professional who has most likely worked very hard for many years to reach the pinnacle of their career with the compensation for some 18 year old who can run fast.
Should the 18 year old get a little more, maybe, should he be making millions, hell no.

There’s a guy in my neighborhood that has a beagle. I always know when the beagle is being walked. She walks for two feet, sniffs, bays… walks 2 feet, sniffs, bays… over and over until they finally get home. I can hear her from inside the house with the AC blasting and my radio on. To be fair Cleet, Ohio state also self reported everything when they found out. Tress didn’t but when the AD found out it all went to the NCAA and the school has cooperated every step of the way. Only USC did not

Well mmo, that is mainly on Tressel. And they only self-reported on the tattoos, as we are seeing now there was a slew of other things. The main point is that UNC took more pre-emptive measures once this was discovered. However, considering OSU was about to play in the Sugar Bowl, I doubt another school would not have handled that the same way.

I thought the NCAA already says sugar bowl win is safe? Regarding the other things coming out now nothing yet has been proved (the Ohio DMV said no deals were given re the cars) but I suppose that could change. Tress covered it up but when the university found out they reported it.
