Lawyers Laughed and Ripped ESPN’s Lester Munson For His Barry Bonds Trial Analysis
Lester Munson: ESPN’s legal expert seems to think the prosecution side was victorious in its case against Barry Bonds. Lawyers disagree. From Above the Law: “The jurors wanted to convict him of perjury but couldn’t do it because the prosecutors couldn’t meet their burden, but the defense went 0-for-4? WHAT THE F*** IS THIS MAN TALKING ABOUT? HOW ARE WE LIVING IN A WORLD WHERE THAT’S THE MAN TELLING LAYPEOPLE HOW TO FEEL ABOUT THIS TRIAL?” From Hanging Sliders: “Munson’s so called ‘legal analysis’ is so full of factual, legal and constitutional errors that it’s hard to believe any reputable news organization would publish it.” [Above the Law]

I think we are giving ESPN a little too much credit here.

Both of those pieces are awesome in their takedowns. Munson has been awful. Which, of course, makes him a perfectly typical fit for cable TV.

I’m glad we are keeping with the Segal theme today.

Munson really got served. This is totally awesome.
/doesn’t give a shit

I bet the image of Lester Munson furiously masturbating keeps children up at nights.

typical ESPN, just throwing shit up against the wall again. they really have no regard for factual presentation

Hey, in a way it’s a victory. An athlete not named Rae Carruth is actually guilty of something.

Unconfirmed by me.

You’re missing Executive Decision. That flick rocks.
April 15th, 2011 at 11:40 AM
well, what do you expect from a guy named Munson?
April 15th, 2011 at 11:40 AM
Damn. I do like that movie. I always forget he’s in that one since he’s not in it for very long. I’d throw that in the top 4 easily. Probably better than Under Seige.

In terms of what? I think most would agree that Under Siege is by far his best “movie” movie. Andrew Davis, Tommy Lee Jones, etc. Easily the most credible. But I agree, Hard to Kill brings it. Especially when he trades the bullet-riddle jeep straight up.

According to the bottom line, ESPN, ESPN.com, and ESPN360.com’s Tim Kurkjian reported this on ESPN Radio’s Mike & Mike in the morning, and later re-confirmed it on the ESPNRADIO affiliate in Chicago.

Agreed completely with the Under Seige thought. I ranked them based on the enjoyment I get out of watching them. For a time, I even named my wang Mason Storm.
/Really enjoys Hard to Kill

In truth, the legal “analysis” linked in those 2 posts was weak and NOTHING more than the exact same analysis/explanation Munson provided, only if it were provided by a left-wing former defense attorney. The real truth is that the judge in ANY criminal case has as big of an impact on the outcome as the lawyers. Judges rule on objections to admissibility of evidence throughout almost every trial, including motions in limine. The same piece of evidence might be excluded by one judge as not being “reliable” enough to be allowed, while another judge will say the objection goes to “weight” not admissibility. Meaning it’s up to the jury to decide if that evidence is reliable and to what extent. You have a left-wing judge appointed by a left-wing president, you get one outcome. You have right-wing judge appointed by a right-wing president, you get another outcome. It all depends on a SINGLE judge’s opinion.
Furthermore and finally, it was not a “victory” for Bonds’ legal team. At best, it was a draw. Bonds was not found innocent or “not guilty” on the three perjury charges. It was a hung jury. In a criminal trial, that could mean ONE JUROR out of twelve wouldn’t vote guilty. Just ask Ron and Nicole whether OJ really did it.

If the Feds are coming after you with a perjury charge for lying about drugs, and they aren’t able to convict you on perjury, it’s a victory, period.
April 15th, 2011 at 8:07 PM
Aren’t able to convict him…YET. Clearly, Barry’s a liar. Let’s see if the Feds decide to try him again. Let’s see if Greg Anderson is willing to go to jail, yet again, on a fresh new set of contempt charges. It ain’t over till it’s over!
